AN ACT TO DIRECT THE MISSISSIPPI DEPARTMENT OF HUMAN SERVICES TO SUBMIT AN AMENDMENT TO THE MISSISSIPPI CHILD CARE DEVELOPMENT FUND (CCDF) PLAN TO THE FEDERAL GOVERNMENT TO PROVIDE THAT CERTAIN PARENTS OR PRIMARY CAREGIVERS OF CHILDREN WILL BE ELIGIBLE FOR CHILD CARE SERVICES UNDER THE MISSISSIPPI CHILD CARE PAYMENT PROGRAM (CCPP) AND TO PROVIDE FOR AN APPEAL BY A CHILD CARE PROVIDER OR THE CHILD'S PARENT OR PRIMARY CAREGIVER TO THE ATTORNEY GENERAL OF THE DENIAL OR REVOCATION OF ELIGIBILITY FOR A CHILD CARE CERTIFICATE; TO DIRECT THE DEPARTMENT OF HUMAN SERVICES TO IMPLEMENT THE PROVISIONS OF THE PLAN AMENDMENT IN THE CCPP AFTER THE AMENDMENT IS APPROVED; AND FOR RELATED PURPOSES.

TO IMPLEMENT THE PROVISIONS OF THE PLAN AMENDMENT IN THE CCPP 10
AFTER THE AMENDMENT IS APPROVED; AND FOR RELATED PURPOSES. 11
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. (1) The Mississippi Department of Human Services 13
shall submit an amendment to the Mississippi Child Care 14
Development Fund (CCDF) Plan to the Assistant Secretary for 15
Children and Families of the United States Department of Health 16
and Human Services to include the following provisions in the 17
Mississippi Child Care Payment Program (CCPP): 18
(a) Provide that the following persons who meet the 19
income and asset requirements of the program will be eligible for 20
child care services under the CCPP: 21

(i) A person enrolled full time in high school who 22
is the parent or primary caregiver of one or more children who 23
reside with that person; 24
(ii) A person twenty-four (24) years of age or 25
younger who is enrolled full time in college or another 26
educational program or a job training program and who is the 27
parent or primary caregiver of two or more children who reside 28
with that person; 29
(iii) A person who is disabled and who is the 30
parent or primary caregiver of one or more children who reside 31
with that person; and 32
(iv) A person who is the grandparent of one or 33
more children who reside with that person and who is the primary 34
caregiver of those children because the child's or children's 35
parent or parents are in a correctional facility. 36
(b) Provide that a child care provider or the child's 37
parent or primary caregiver may appeal the denial or revocation of 38
eligibility for a child care certificate to the Attorney General's 39
Office, which appeal will be heard by an attorney who is not 40
assigned to the Department of Human Services. 41
(2) After the plan amendment provided for in subsection (1) 42
of this section is approved, the Department of Human Services 43
shall implement the provisions of the amendment in the CCPP. 44
SECTION 2. This act shall take effect and be in force from 45
and after July 1, 2026. 46
