SENATE BILL NO. 2469
AN ACT TO DIRECT THE STATE PERSONNEL BOARD TO AMEND THE 1
VARIABLE COMPENSATION PLAN AS NECESSARY TO AWARD A SALARY INCREASE 2
TO EACH STATE EMPLOYEE WHOSE SALARY IS FUNDED BY THE STATE GENERAL 3
FUND IN THE AMOUNT OF A 6% ACROSS-THE-BOARD INCREASE PER YEAR 4
BEGINNING JULY 1, 2026; TO BRING FORWARD SECTIONS 25-9-147 AND 5
25-9-148, MISSISSIPPI CODE OF 1972, WHICH ARE PROVISIONS RELATED 6
TO THE COLONEL GUY GROFF/NEVILLE KENNING VARIABLE COMPENSATION 7
PLAN, FOR POSSIBLE AMENDMENT; AND FOR RELATED PURPOSES. 8
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 9
SECTION 1. The State Personnel Board and the responsible 10
officer of every state agency, authority, board, commission or 11
department in whom is vested the authority to set employee 12
compensation are hereby directed, on July 1, 2026, to grant an 13
increase in salary to each full-time state employee under their 14
respective jurisdictions whose salary is funded by the State 15
General Fund, pursuant to appropriation therefor by the 16
Legislature, which increase shall be an amount of six percent (6%) 17
per year over and above that sum which is the annual compensation 18
of the employee in effect on June 30, 2026. Part-time state 19
employees shall receive a pro rata share of a six percent (6%) 20
salary increase based on the amount of time worked per week. The 21

State Personnel Board shall amend the State Variable Compensation 22
in accordance with this requirement. 23
SECTION 2. Section 25-9-147, Mississippi Code of 1972, is 24
brought forward as follows: 25
25-9-147. The State Personnel Board shall review on an 26
annual basis the variable compensation plan adopted by the 27
Legislature at the regular session of 1981 and subsequently 28
implemented by the State Personnel Board. Each state department 29
or agency subject to the variable compensation plan shall prepare 30
an annual written report under the direction of the head of that 31
department or agency outlining the impact which the plan has had 32
on that department or agency during the preceding fiscal year. 33
Such department or agency report shall be submitted to the State 34
Personnel Board and shall become a part of the board's annual 35
review of the variable compensation plan. After conducting its 36
annual review of the plan and studying the report of each 37
department or agency, the State Personnel Board shall prepare a 38
written legislative report, to be submitted to the members of the 39
Mississippi Legislature prior to January 1 of each year. This 40
written report shall accurately reflect the effect of the variable 41
compensation plan on the various departments or agencies subject 42
to the plan. From and after July 1, 1985, the plan shall be named 43
the "Colonel Guy Groff State Variable Compensation Plan." From 44
and after July 1, 2022, the plan shall be named the "Colonel Guy 45
Groff/Neville Kenning Variable Compensation Plan." 46

SECTION 3. Section 25-9-148, Mississippi Code of 1972, is 47
brought forward as follows: 48
25-9-148. Before September 1, 1996, and before September 1 49
of every year thereafter, the State Personnel Board shall prepare 50
a written report to be submitted to the Chairmen of the House of 51
Representatives Appropriations and Fees and Salaries of Public 52
Officers Committees, the Chairmen of the Senate Appropriations and 53
Fees, Salaries and Administration Committees and the Legislative 54
Budget Office specifically describing every increase in 55
compensation, other than salary increases authorized by the 56
Legislature, or additional compensation that was awarded to any 57
state officer, administrator, executive head, employee or 58
employees during the next preceding fiscal year. For each 59
increase or additional compensation awarded, the report shall 60
include no less than the following information: the annual salary 61
of the officer, administrator, executive head or employee before 62
the increase; the total amount of the increase or additional 63
compensation; the justification for the increase or additional 64
compensation; the effective date of the increase or additional 65
compensation; and the source of the additional compensation, 66
including federal or private funds. 67
SECTION 4. This act shall take effect and be in force from 68
and after July 1, 2026. 69
