AN ACT TO DIRECT THE STATE FISCAL OFFICER TO TRANSFER 1
$265,000,000.00 FROM THE CAPITAL EXPENSE FUND TO THE CAPACITY 2
PROJECT FUND UPON THE EFFECTIVE DATE OF THIS ACT; TO AMEND SECTION 3
65-1-141.2, MISSISSIPPI CODE OF 1972, TO MAKE A MINOR, 4
NONSUBSTANTIVE REVISION; AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Upon the effective date of this act, the State 7
Fiscal Officer shall transfer the sum of Two Hundred Sixty-five 8
Million Dollars ($265,000,000.00) from the Capital Expense Fund 9
(Fund No. 6499C00000) to the Capacity Project Fund (Fund No. 10
6619420000), created in Section 65–1–141.2. 11
SECTION 2. Section 65-1-141.2, Mississippi Code of 1972, is 12
amended as follows: 13
65-1-141.2. There is created in the State Treasury a special 14
fund to be designated as the " * * * Capacity Project Fund," which 15
shall consist of funds made available by the Legislature in any 16
manner and funds from any other source designated for deposit into 17
such fund. The fund shall be maintained by the State Treasurer as 18
a separate and special fund, separate and apart from the General 19

Fund of the state. Unexpended amounts remaining in the fund at 20
the end of a fiscal year shall not lapse into the State General 21
Fund, and any investment earnings or interest earned on amounts in 22
the fund shall be deposited to the credit of the fund. Monies in 23
the fund shall be used by the Department of Transportation, upon 24
appropriation by the Legislature, to provide for capacity projects 25
included in the Capacity Program of the Three-Year Plan as adopted 26
by, amended by, or reissued by the Mississippi Transportation 27
Commission under the authority of Section 65-1-141. 28
SECTION 3. This act shall take effect and be in force from 29
and after its passage. 30
