BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 16
SECTION 1. This act shall be known and may be cited as the 17
"Mississippi Immunization Privacy and Parental Rights Act." 18
SECTION 2. The purpose of this act is to ensure that 19
Mississippi families have the right to control whether their 20
child's or their own immunization information is stored, retained 21
or disclosed within the Mississippi Immunization Information 22
eXchange (MIIX), and to ensure that no individual is entered into 23
the system without being fully informed of the right to opt out. 24

SECTION 3. For purposes of this act: 25
(a) "MIIX" means the Mississippi Immunization 26
Information eXchange operated by the Mississippi State Department 27
of Health. 28
(b) "Department" means the Mississippi State Department 29
of Health. 30
(c) "Provider" means any healthcare professional, 31
clinic, facility, pharmacy, hospital or other entity authorized to 32
administer vaccines in Mississippi. 33
(d) "Parent" includes a legal guardian and a person 34
standing in loco parentis. 35
(e) "Individual" means an adult eighteen (18) years of 36
age or older or the parent of a minor child. 37
SECTION 4. (1) No individual shall be required to have 38
their immunization information stored or maintained in MIIX. 39
(2) Parents shall have the right to opt their minor children 40
out of MIIX at any time. 41
(3) Adults shall have the right to opt themselves out of 42
MIIX at any time. 43
SECTION 5. (1) A provider shall not enter or transmit any 44
immunization record, demographic information, or other identifying 45
information about a child into MIIX unless: 46
(a) The provider has first given the parent a written 47
notice of their right to opt out; and 48
(b) The parent has not exercised the opt-out right. 49

(2) For adults, no record shall be entered into MIIX unless 50
the individual has been notified in writing of the right to opt 51
out and has not exercised that right. 52
(3) The Mississippi State Department of Health shall create a 53
standard one-page disclosure form for use statewide. 54
SECTION 6. (1) An individual or parent may opt out of MIIX 55
by doing any of the following: 56
(a) Submitting a written opt-out request to their 57
provider; 58
(b) Submitting a written or electronic opt-out request 59
directly to the Mississippi State Department of Health; or 60
(c) Completing an online form, if offered by the 61
department. 62
(2) Providers shall forward any opt-out forms received to the 63
department within five (5) business days. 64
SECTION 7. (1) Upon receipt of an opt-out request, the 65
Mississippi State Department of Health shall remove the 66
individual's record from MIIX within thirty (30) days. 67
(2) Removed data shall not be retained, archived, disclosed 68
or otherwise used for any purpose except to document that the 69
individual opted out. 70
(3) The department shall provide written confirmation to the 71
individual or parent when removal is complete. 72
SECTION 8. (1) No individual may be denied medical care, 73
school enrollment, daycare enrollment, insurance coverage, 74

employment or any other service or benefit because the individual 75
or parent elected to opt out of MIIX. 76
(2) Providers may not condition vaccine administration on 77
participation in MIIX. 78
SECTION 9. (1) Any provider who knowingly enters 79
immunization information into MIIX without meeting the 80
informed-consent requirements of this act shall be subject to: 81
(a) A civil penalty not to exceed One Thousand Dollars 82
($1,000.00) per affected individual; or 83
(b) Disciplinary action by their licensing board. 84
(2) A parent or individual whose rights under this act are 85
violated may bring a civil action for damages, injunctive relief 86
and attorney's fees. 87
SECTION 10. The Mississippi State Department of Health shall 88
promulgate rules necessary to implement this act, including 89
standardized notice forms and procedures for opt-out, data removal 90
and provider reporting. 91
SECTION 11. Nothing in this act shall be construed to 92
prohibit providers from maintaining immunization records in their 93
own medical files or from complying with other state reporting 94
requirements not related to MIIX participation. 95
SECTION 12. This act shall take effect and be in force from 96
and after July 1, 2026. 97
