AN ACT TO PROVIDE THAT EFFECTIVE JANUARY 1, 2027, ALL 1
RADIATION ONCOLOGY FACILITIES IN THE STATE SHALL BE ACCREDITED AND 2
CERTIFIED BY THE STATE DEPARTMENT OF HEALTH TO ENSURE QUALITY AND 3
SAFETY; TO PROVIDE PENALTIES FOR NONCOMPLIANCE; AND FOR RELATED 4
PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. (1) Effective January 1, 2027, all radiation 7
oncology facilities located in the State of Mississippi shall be 8
accredited by the American College of Radiology (ACR) and the 9
American Society for Radiation Oncology (ASTRO) and certified by 10
the Division of Health Facilities Licensure and Certification of 11
the State Department of Health to ensure quality and safety. This 12
requirement shall be applicable to: 13
(a) Radiation oncology outpatient units within 14
hospitals; 15
(b) Independent, freestanding centers focusing 16
specifically on radiation treatment; and 17
(c) Comprehensive centers which offer radiation 18
oncology with chemotherapy for patient convenience. 19

(2) For purposes of this act, "radiation oncology 21
facilities" shall mean specialized medical environments designed 22
for the treatment of cancer and certain benign conditions using 23
high-energy, ionizing radiation such as x-rays or proton beams, 24
designed to destroy tumor cells while minimizing damage to 25
surrounding health tissue. 26
(3) Any radiation oncology facility which is not in 27
compliance with this act shall not be eligible for Medicaid 28
reimbursement for providing any medical service. 29
SECTION 2. This act shall take effect and be in force from 30
and after July 1, 2026. 31
