AN ACT TO EXEMPT CERTAIN REGISTERED PROVIDERS OF SERVICES FOR 1
HOMELESS PERSONS FROM CERTAIN FILING FEES AND LICENSURE 2
APPLICATION FEES; TO AMEND SECTIONS 25-7-9 AND 63-1-43, 3
MISSISSIPPI CODE OF 1972, TO CONFORM; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Providers of services for homeless persons 6
registered with a Continuum of Care Program shall be exempted: 7
(a) From the civil filing fees in chancery court for 8
matters relating to the alteration of birth and marriage 9
certificates for homeless persons. 10
(b) From the application fees for driver's licenses, 11
identifications cards, or learner's permits under Section 63-1-43 12
for homeless persons. 13
SECTION 2. Section 25-7-9, Mississippi Code of 1972, is 14
amended as follows: 15
[From and after January 1, 2024, and through December 31, 16
2027, this section shall read as follows:] 17
25-7-9. (1) The clerks of the chancery courts shall charge 18
the following fees: 19

(a) For the act of certifying copies of filed 20
documents, for each complete document................... $ 1.00 21
(b) (i) Recording each deed, will, lease, amendment, 22
subordination, lien, release, cancellation, order, decree, oath, 23
etc., per book and page listed where applicable, each deed of 24
trust, or any other document, for the first five (5) 25

(c) (i) Recording oil and gas leases, cancellations, 28

Provided that the fees herein prescribed shall be the total 61
remuneration for the clerk and his deputies for attending chancery 62
court. 63
(h) On order of the court, clerks and not more than two 64
(2) deputies may be allowed five (5) extra days for each term of 65
court for attendance upon the court to get up records. 66
(i) For public service not otherwise specifically 67
provided for, the chancery court may by order allow the clerk to 68

be paid by the county on the order of the board of supervisors, an 69
annual sum not exceeding................................ $ 5,000.00 70
(j) For each civil filing, to be deposited into the 71
Civil Legal Assistance Fund............................. $ 5.00 72
The chancery clerk shall itemize on the original document a 73
detailed fee bill of all charges due or paid for filing, recording 74
and abstracting same. No person shall be required to pay such 75
fees until same have been so itemized, but those fees may be 76
demanded before the document is recorded. 77
(2) The following fee shall be a total fee for all services 78
performed by the clerk with respect to any civil case filed that 79
includes, but is not limited to, divorce, alteration of birth or 80
marriage certificate, removal of minority, guardianship or 81
conservatorship, estate of deceased, adoption that does not 82
involve the Department of Child Protection Services, land dispute 83
injunction, settlement of small claim, contempt, modification, 84
partition suit, or commitment, which shall be payable upon filing 85
and shall accrue to the chancery clerk at the time of filing. The 86
clerk or his successor in office shall perform all duties set 87
forth without additional compensation or fee............ $ 85.00 88
(3) For every civil case filed: 89
(a) An additional fee to be deposited to the credit of 90
the Comprehensive Electronic Court Systems Fund established in 91
Section 9-21-14.......................................... $ 10.00 92

credit of the Judicial System Operation Fund established in 94

(4) Cost of process shall be borne by the issuing party. 96
Additionally, should the attorney or person filing the pleadings 97
desire the clerk to pay the cost to the sheriff for serving 98
process on one (1) person or more, or to pay the cost of 99
publication, the clerk shall demand the actual charges therefor, 100
at the time of filing. 101
(5) For each civil case filed including an adoption 102
involving the Department of Child Protection Services or 103
alteration of a birth or marriage certificate for homeless persons 104
under Section 1 of this act, the filing shall be exempt from any 105
fee under this section. 106
[From and after January 1, 2028, this section shall read as 107

SECTION 3. Section 63-1-43, Mississippi Code of 1972, is 198
amended as follows: 199
63-1-43. (1) The commissioner shall charge and collect the 200
following fees: 201
(a) Fees to which the card stock fee authorized in 202
Section 45-1-21 shall be added: 203

(c) In addition to the fees required in this section, 249
an applicant may contribute an additional One Dollar ($1.00) which 250
shall be deposited into the Statewide Litter Prevention Fund. The 251
applicant shall be informed that he or she may contribute an 252
additional One Dollar ($1.00) which shall be deposited into the 253
Statewide Litter Prevention Fund and shall be expended solely for 254
the purpose of funding litter prevention projects or litter 255
education programs, as recommended by the Statewide Litter 256
Prevention Program of Keep Mississippi Beautiful, Inc. 257
(d) Starting January 1, 2021, for any original or 258
renewal license for which the fee is greater than Ten Dollars 259
($10.00), if the applicant brings all required documentation but 260
does not receive his or her license within two and one-half 261
(2-1/2) hours of entering and remaining at the license station, 262
Ten Dollars ($10.00) shall be deducted from the total amount owed 263
for the license. 264

(2) All originals and renewals of operators' licenses shall 265
be in compliance with Section 63-1-47. 266
(3) Notwithstanding any provision of law to the contrary in 267
this section, the commissioner shall waive the driver's license, 268
identification card, or learner's permit fee for any applicant in 269
the custody of the Department of Child Protection Services and for 270
any applicant under Section 1 of this act. 271
SECTION 4. This act shall take effect and be in force from 272
and after July 1, 2026. 273
