AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION TO DONATE TO THE CITY OF RIDGELAND, MISSISSIPPI, A CERTAIN PARCEL OF LAND SITUATED IN RIDGELAND, MISSISSIPPI; TO STIPULATE THAT THE STATE OF MISSISSIPPI SHALL RETAIN MINERAL RIGHTS; TO AUTHORIZE THE DEPARTMENT OF TRANSPORTATION TO CORRECT ANY DISCREPANCIES IN THE LEGAL DESCRIPTION OF THE PROPERTY PROVIDED IN THIS SECTION; TO AMEND SECTION 1, CHAPTER 414, LAWS OF 2025, TO CORRECT THE METHOD BY WHICH THE STATE HIGHWAY COMMISSION, ACTING ON BEHALF OF THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION, IS AUTHORIZED TO DONATE TO THE CITY OF GULFPORT, MISSISSIPPI, CERTAIN PARCELS OF LAND SITUATED IN GULFPORT, MISSISSIPPI, AT THE INTERSECTIONS OF 13TH STREET AND 28TH AVENUE AND 15TH STREET AND 28TH AVENUE; TO AMEND SECTION 1, CHAPTER 393, LAWS OF 2019, TO PROVIDE THE MISSISSIPPI DEVELOPMENT AUTHORITY TO SELL CERTAIN REAL PROPERTY LOCATED IN LOWNDES COUNTY AND THE CITY OF COLUMBUS, MISSISSIPPI, TO PROVIDE THAT ANY PROCEEDS GENERATED FROM THE SALE OF THE LAND SHALL BE DEPOSITED INTO THE MISSISSIPPI EXISTING INDUSTRY PRODUCTIVITY LOAN PROGRAM BOND SINKING FUND; TO PROVIDE THAT MDA MAY CORRECT ANY DISCREPANCIES IN THE LEGAL DESCRIPTION OF THE PROPERTY; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 21
SECTION 1. (1) The Mississippi Department of Transportation 22
is authorized to donate to the City of Ridgeland, Mississippi, at 23
no cost certain real property and any improvements thereon located 24
in Ridgeland, Mississippi, and being more particularly described 25
as follows: 26

COMMENCING at a found 1" square iron bar representing 28
the Northwest corner of Section 24, Township 7 North, Range 1 29
East, Madison County, Mississippi, having grid coordinates N= 30
1,070,881.727, E= 2,350,696.771 based on the Mississippi 31
State Plane Coordinates System, West Zone, NAD83 (93), 32
coordinates and courses herein are grid values based on said 33
coordinate system, using a combined factor of 0.999954143 and 34
a delta alpha angle of plus (+)00°06'17'' as developed by the 35
Mississippi Department of Transportation for this Project; 36
run thence South 44°02'38" East a distance of 6906.45 feet to 37
the Old Agency Road Project Centerline at Station 25+50.68, 38

(2) The State of Mississippi shall retain all mineral rights 73
to the real property transferred by means of donation under this 74
section. 75

(3) The Mississippi Department of Transportation is 76
authorized to correct any discrepancies in the legal description 77
of the property provided in this section. 78
SECTION 2. Section 1, Chapter 414, Laws of 2025, is amended 79
as follows: 80
Section 1. (1) The State Highway Commission, acting on 81
behalf of the Mississippi Department of Transportation, is 82
authorized to * * * donate to the City of Gulfport, Mississippi, 83
certain real property and any improvements thereon located in 84
Gulfport, Mississippi, for the purpose of public use or private 85
sale and being more particularly described as follows: 86
(a) The Northwest Quadrant of the intersection of 13th 87
Street and 28th Avenue in the City of Gulfport, Harrison County, 88
Mississippi, including Lots 15 through 19 in Block 176 of Original 89
Gulfport; and 90
(b) The Southwest Quadrant of the intersection of 15th 91
Street and 28th Avenue in the City of Gulfport, Harrison County, 92
Mississippi, including Lots 1 through 6 in Block 176 of Original 93
Gulfport. 94
(2) Of the property described in subsection (1) of this 95
section, it is hereby understood and agreed by the City of 96
Gulfport, Mississippi, as the grantee herein named, that all 97
existing utilities located on, under or above the property herein 98
described, shall remain at the discretion of the utility owners, 99
and that the grantee, its assigns or successors in the title will 100

not require the relocation of these utilities except by agreement 101
with the utility owner. 102
(3) The State of Mississippi shall retain all mineral rights 103
to the real property transferred by means of donation under this 104
section. 105
(4) The Mississippi Department of Transportation is 106
authorized to correct any discrepancies in the legal description 107
of the property provided in this section. 108
(5) In the event that the City of Gulfport determines to 109
offer either parcel for sale, the Mississippi Department of 110
Transportation shall have the right of first refusal. 111
SECTION 3. Section 1, Chapter 393, Laws of 2019, is amended 112
as follows: 113

authorized to sell, lease or otherwise dispose of, in whole or in 115
part, in a manner as determined in the sole discretion of the 116
authority, the following described real property and any 117

(3) In the event that any or all of the real property and 170
improvements described in subsection (1) of this section is sold, 171
the real property shall be sold for not less than the current fair 172
market value as determined by the average of two (2) appraisals by 173
qualified appraisers, one (1) of whom shall be selected by 174

shall be certified and licensed by the Mississippi Real Estate 176
Appraiser Licensing and Certification Board. 177
(4) Any proceeds from the sale of the land, and any 178
improvements thereon, listed in subsection (1) of this section, 179
shall be deposited into the * * * Mississippi Existing Industry 180
Productivity Loan Program Bond Sinking Fund, established under 181
Section 57-93-1, and administered by the Mississippi Development 182
Authority. 183
(5) The * * * Mississippi Development Authority may correct 184
any discrepancies in the legal description of the property 185
provided in this section. 186
SECTION 4. This act shall take effect and be in force from 187
and after July 1, 2026. 188
