AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF FINANCE AND ADMINISTRATION TO TRANSFER AND CONVEY REAL PROPERTY AND IMPROVEMENTS THEREON IN MADISON, MISSISSIPPI, COMMONLY KNOWN AS THE ABC WAREHOUSE, TO THE MADISON COUNTY ECONOMIC DEVELOPMENT AUTHORITY; TO REQUIRE THE DEPARTMENT TO OBTAIN A LEGAL DESCRIPTION OF THE PROPERTY PRIOR TO CONVEYANCE AND INCLUDE SUCH DESCRIPTION IN THE DEED OR INSTRUMENT OF CONVEYANCE; TO DESCRIBE THE MANNER OF SALE; TO REQUIRE THAT THE PROPERTY BE SOLD FOR NOT LESS THAN FAIR MARKET VALUE AS DETERMINED BY TWO PROFESSIONAL, CERTIFIED GENERAL APPRAISERS; TO AUTHORIZE THE DEPARTMENT TO EXECUTE AND DELIVER DEEDS, BILLS OF SALE OR OTHER INSTRUMENTS NECESSARY TO CONVEY THE PROPERTY; TO REQUIRE REMAINING PROCEEDS FROM THE SALE TO BE DEPOSITED INTO THE STATE GENERAL FUND; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 14
SECTION 1. (1) The Mississippi Department of Finance and 15
Administration is authorized to transfer to the Madison County 16
Economic Development Authority, certain real property located at 17
1286 Gluckstadt Road, Madison, Mississippi, commonly known as the 18
ABC Warehouse, together with any improvements located thereon and 19
any property related thereto. 20
(2) The Department of Finance and Administration shall 21
obtain a legal description of the property prior to conveyance, 22

and such legal description shall be included in the deed or other 23
instrument of conveyance. 24
(3) The transfer and conveyance authorized in subsection (1) 25
of this section may be made at a public or private sale, for cash 26
or upon such other terms and conditions as the Department of 27
Finance and Administration may deem appropriate and in the best 28
interest of the State of Mississippi. The department is 29
authorized to advertise the sale in such manner as it determines 30
appropriate and may determine the manner and timing of the sale. 31
(4) The property shall be sold for not less than fair market 32
value as determined by two (2) professional, certified general 33
appraisers selected by the Department of Finance and 34
Administration according to Section 29-1-1. 35
(5) The Department of Finance and Administration is 36
authorized to execute and deliver, in the name of and on behalf of 37
the State of Mississippi, any deeds, bills of sale or other 38
instruments necessary to convey the property. 39
(6) The State of Mississippi shall retain all mineral rights 40
to the real property transferred under this section. 41
(7) The Mississippi Department of Finance and Administration 42
is authorized to correct any discrepancies in the legal 43
description of the property provided in this section. 44
(8) The proceeds derived from the sale of the real property 45
and improvements under this act, after the deduction of reasonable 46

costs and expenses incurred in connection with the sale, shall be 47
deposited into the State General Fund. 48
SECTION 2. This act shall take effect and be in force from 49
and after its passage. 50
