SENATE BILL NO. 2600
AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND 1
ADMINISTRATION TO TRANSFER AND CONVEY REAL PROPERTY AND 2
IMPROVEMENTS THEREON IN BILOXI, MISSISSIPPI, COMMONLY KNOWN AS THE 3
DR. EDON LANGSTON BOLTON STATE OFFICE BUILDING; TO REQUIRE THE 4
DEPARTMENT TO OBTAIN A LEGAL DESCRIPTION OF THE PROPERTY PRIOR TO 5
CONVEYANCE AND INCLUDE SUCH DESCRIPTION IN THE DEED OR INSTRUMENT 6
OF CONVEYANCE; TO DESCRIBE THE MANNER OF SALE; TO REQUIRE THAT THE 7
PROPERTY BE SOLD FOR NOT LESS THAN FAIR MARKET VALUE AS DETERMINED 8
BY TWO PROFESSIONAL, CERTIFIED GENERAL APPRAISERS; TO AUTHORIZE 9
THE DEPARTMENT TO EXECUTE AND DELIVER DEEDS, BILLS OF SALE OR 10
OTHER INSTRUMENTS NECESSARY TO CONVEY THE PROPERTY; TO REQUIRE 11
REMAINING PROCEEDS FROM THE SALE TO BE DEPOSITED INTO THE STATE 12
GENERAL FUND; AND FOR RELATED PURPOSES. 13
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 14
SECTION 1. (1) The Department of Finance and 15
Administration, acting on behalf of the State of Mississippi, is 16
authorized to sell and convey all right, title and interest of the 17
State of Mississippi in and to the real property and improvements 18
thereon located at 1141 Bayview Avenue, Biloxi, Mississippi, 19
commonly known as the Dr. Edon Langston Bolton State Office 20
Building, together with any improvements located thereon and any 21
property related thereto. 22

Building; authorize DFA to transfer and convey.
(2) The Department of Finance and Administration shall 23
obtain a legal description of the property prior to conveyance, 24
and such legal description shall be included in the deed or other 25
instrument of conveyance. 26
(3) The transfer and conveyance authorized in subsection (1) 27
of this section may be made at a public or private sale, for cash 28
or upon such other terms and conditions as the Department of 29
Finance and Administration may deem appropriate and in the best 30
interest of the State of Mississippi. The department is 31
authorized to advertise the sale in such manner as it determines 32
appropriate and may determine the manner and timing of the sale. 33
(4) The property shall be sold for not less than fair market 34
value as determined by two (2) professional, certified general 35
appraisers selected by the Department of Finance and 36
Administration according to Section 29-1-1. 37
(5) The Department of Finance and Administration is 38
authorized to execute and deliver, in the name of and on behalf of 39
the State of Mississippi, any deeds, bills of sale or other 40
instruments necessary to convey the property. 41
(6) The proceeds derived from the sale of the real property 42
and improvements authorized under this act, after deduction of 43
reasonable costs and expenses incurred in connection with the 44
sale, shall be deposited into the State General Fund. 45
SECTION 2. This act shall take effect and be in force from 46
and after its passage. 47
