AN ACT TO AMEND SECTION 25-1-1, MISSISSIPPI CODE OF 1972, TO 1
ESTABLISH THE MISSISSIPPI DEMOCRATIC ACCOUNTABILITY IN BOARD 2
APPOINTMENTS ACT, WHICH ALLOWS THE PERSON OR ENTITY WITH 3
APPOINTING AUTHORITY GREATER DISCRETION WHEN MAKING APPOINTMENTS 4
FOR A STATE BOARD OR COMMISSION; AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 25-1-1, Mississippi Code of 1972, is 7
amended as follows: 8
25-1-1. (1) The term of office of all officers, not 9
otherwise provided for by law, shall be four (4) years and until 10
their successors shall be duly qualified. 11
(2) Notwithstanding any other provision of state law to the 12
contrary, the person or entity with appointing authority for any 13
state board or commission is not restricted in his or her 14
selection of qualified candidates for appointment by lists or 15
other nominations generated by the board or commission at issue, 16
or by leaders or groups within any professional or other 17
association. 18

(3) Preexisting laws that require the appointing authority 19
to select candidates for appointment for state boards or 20
commissions from a list generated by another person or entity 21
shall have no force or effect, except that the appointing 22
authority is free to consider recommendations of appointment from 23
any individual or group in the state. 24
SECTION 2. This act shall take effect and be in force from 25
and after July 1, 2026. 26
