AN ACT TO CREATE NEW SECTION 25-61-11.3, MISSISSIPPI CODE OF 1972, TO EXEMPT FROM THE MISSISSIPPI PUBLIC RECORDS ACT OF 1983 CERTAIN INFORMATION COMPILED OR COLLECTED FOR THE PURPOSE OF IDENTIFYING, EVALUATING OR PLANNING THE SAFETY ENHANCEMENT OF POTENTIAL ACCIDENT SITES, HAZARDOUS ROADWAY CONDITIONS OR RAILWAY HIGHWAY CROSSINGS, PURSUANT TO FEDERAL LAW OR FOR THE PURPOSE OF DEVELOPING ANY HIGHWAY SAFETY CONSTRUCTION IMPROVEMENT PROJECT WHICH MAY BE IMPLEMENTED UTILIZING FEDERAL-AID HIGHWAY FUNDS; AND FOR RELATED PURPOSES.

AN ACT TO CREATE NEW SECTION 25-61-11.3, MISSISSIPPI CODE OF 1

CERTAIN INFORMATION COMPILED OR COLLECTED FOR THE PURPOSE OF 3

POTENTIAL ACCIDENT SITES, HAZARDOUS ROADWAY CONDITIONS OR RAILWAY 5
HIGHWAY CROSSINGS, PURSUANT TO FEDERAL LAW OR FOR THE PURPOSE OF 6
DEVELOPING ANY HIGHWAY SAFETY CONSTRUCTION IMPROVEMENT PROJECT 7
WHICH MAY BE IMPLEMENTED UTILIZING FEDERAL-AID HIGHWAY FUNDS; AND 8
FOR RELATED PURPOSES. 9
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 10
SECTION 1. The following shall be codified as Section 11
25-61-11.3, Mississippi Code of 1972: 12
25-61-11.3 Reports, surveys, schedules, lists or data 13
compiled or collected for the purpose of identifying, evaluating 14
or planning the safety enhancement of potential accident sites, 15
hazardous roadway conditions or railway-highway crossings, 16
pursuant to federal law or for the purpose of developing any 17
highway safety construction improvement project which may be 18
implemented utilizing Federal-aid Highway Funds shall be exempt 19
from the Mississippi Public Records Act of 1983. 20

SECTION 2. This act shall take effect and be in force from 21
