AN ACT TO PROVIDE THAT A CHARITABLE ORGANIZATION SHALL BE IMMUNE FROM CIVIL LIABILITY FOR ANY ACT OR OMISSION ARISING OUT OF, RELATED TO, OR OCCURRING IN CONNECTION WITH THE PROVISION OF SERVICES, ASSISTANCE, AID, SHELTER, TRANSPORTATION, COMMUNICATIONS, LOGISTICS, SECURITY, UTILITIES, EMERGENCY RESPONSE, OR OTHER RELATED ACTIVITIES DURING A DECLARED EMERGENCY, A GOVERNMENT-ORDERED EMERGENCY, OR AN IMPENDING WEATHER EVENT; TO PROVIDE THAT THE IMMUNITY FROM CIVIL LIABILITY GRANTED UNDER THIS ACT SHALL NOT APPLY TO ANY ACT OR OMISSION ARISING OUT OF WANTON, WILLFUL, OR INTENTIONAL MISCONDUCT; TO PROVIDE THAT THE IMMUNITY GRANTED UNDER THIS ACT SHALL NOT BE SUBJECT TO EXCEPTION, LIMITATION, OR QUALIFICATION BASED UPON THE NATURE OF THE CONDUCT GIVING RISE TO THE CLAIM EXCEPT AS PROVIDED IN THIS ACT; TO DEFINE THE TERMS "IMPENDING WEATHER EVENT" AND "CHARITABLE ORGANIZATION"; AND FOR RELATED PURPOSES.

THE TERMS "IMPENDING WEATHER EVENT" AND "CHARITABLE ORGANIZATION"; 14
AND FOR RELATED PURPOSES. 15
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 16
SECTION 1. (1) As used in this act: 17
(a) "Impending weather event" means any forecasted or 18
developing weather condition that poses a credible threat to life, 19
property, or public safety, including, but not limited to, 20
hurricanes, tornadoes, floods, ice storms, extreme heat, extreme 21
cold, or severe storms. 22
(b) "Charitable organization" means a charitable unit 23
of a religious or civic group that is exempt from taxation under 24

26 USC § 501, including those supported wholly or partially by 25
private donations and registered with the Secretary of State. 26
SECTION 2. Notwithstanding any other provision of law, a 27
charitable organization shall be immune from civil liability for 28
any act or omission arising out of, related to, or occurring in 29
connection with the provision of services, assistance, aid, 30
shelter, transportation, communications, logistics, security, 31
utilities, emergency response, or other related activities during: 32
(a) A declared emergency; 33
(b) A government-ordered emergency; or 34
(c) An impending weather event. 35
SECTION 3. The immunity from civil liability granted under 36
this act shall not apply to any act or omission arising out of 37
wanton, willful, or intentional misconduct. 38
SECTION 4. The immunity granted under this act shall not be 39
subject to exception, limitation, or qualification based upon the 40
nature of the conduct giving rise to the claim except as provided 41
in Section 3 of this act. No civil action shall be maintained 42
against a covered organization for conduct occurring during the 43
circumstances described in this act except for conduct described 44
in Section 3 of this act. 45
SECTION 5. This act shall be liberally construed to 46
effectuate its purpose of encouraging rapid, decisive, and 47
effective action during emergencies and impending weather events 48
without fear of civil liability. 49

SECTION 6. This act shall take effect and be in force from 50
and after July 1, 2026. 51
