AN ACT TO REQUIRE ANY CONSUMER REPORTING AGENCY TRANSACTING BUSINESS WITHIN THIS STATE TO PLACE, FREE OF CHARGE, A SECURITY FREEZE ON THE CONSUMER CREDIT REPORT OF A CHILD UPON RECEIVING SUCH A REQUEST FROM THE BUREAU OF VITAL STATISTICS; TO AMEND SECTION 41-57-7, MISSISSIPPI CODE OF 1972, TO REQUIRE THE STATE BOARD OF HEALTH TO PROMULGATE RULES AND REGULATIONS FOR PARENTS IN THIS STATE TO AUTHORIZE THE BUREAU OF VITAL STATISTICS TO REQUEST A SECURITY FREEZE FOR A CHILD WITHIN TEN (10) DAYS OF THE BIRTH OF THE CHILD; TO DIRECT THE PROVISION OF A FORM TO BE GIVEN TO THE PARENT OR PARENTS OF A CHILD BORN WITHIN A HEALTH CARE FACILITY BEFORE THE DISCHARGE OF THE CHILD; AND FOR RELATED PURPOSES.

THE CHILD; TO DIRECT THE PROVISION OF A FORM TO BE GIVEN TO THE 9
PARENT OR PARENTS OF A CHILD BORN WITHIN A HEALTH CARE FACILITY 10
BEFORE THE DISCHARGE OF THE CHILD; AND FOR RELATED PURPOSES. 11
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. (1) (a) Upon receiving a request from the 13
bureau that a consumer reporting agency place a security freeze, 14
any consumer reporting agency transacting business within this 15
state shall, free of charge, place the security freeze in 16
accordance with the procedure described in 15 USC § 1681c-1(i). 17
(b) For the purposes of this section, a consumer 18
reporting agency transacting business within this state shall 19
treat a request from the bureau as if the bureau was the consumer 20
as contemplated in the procedure described in 15 USC § 1681c-1(i). 21

(c) A consumer reporting agency transacting business 22
within this state shall remove a security freeze placed on the 23
consumer report of a consumer only in accordance with the 24
procedure described for such removal in 15 USC § 1681c-1(i) except 25
that a consumer reporting agency transacting business within this 26
state may remove a security freeze placed on the consumer report 27
of a consumer that was placed due to a material misrepresentation 28
of fact by the bureau. 29
(2) As used in this section, the following terms shall have 30
the meaning ascribed herein unless the context requires otherwise: 31
(a) "Bureau" means the Bureau of Vital Statistics 32
established under Section 41-57-1. 33
(b) "Consumer reporting agency" shall have the meaning 34
assigned in 15 USC § 1681a. 35
(c) "Security freeze" shall have the meaning assigned 36
in 15 USC § 1681c-1(i)(1)(C). 37
SECTION 2. Section 41-57-7, Mississippi Code of 1972, is 38
amended as follows: 39
41-57-7. (1) (a) The State Board of Health shall formulate 40
and promulgate rules and regulations for the proper reporting and 41
registration of morbidity and vital statistics, prescribing the 42
method and form of making such registration. 43
(b) Each application or filing made under this section 44
shall include the social security number(s) of the applicant in 45
accordance with Section 93-11-64, Mississippi Code of 1972. 46

(2) (a) The State Board of Health shall formulate and 47
promulgate rules and regulations for parents in this state to 48
authorize the bureau to request a security freeze under Section 1 49
of this act and the procedure described in 15 USC § 1681c-1(i) for 50
a child within ten (10) days of the birth of the child. 51
(b) For a child who is born within a health care 52
facility, the rules and regulations promulgated under this 53
subsection shall provide for a form to be executed by a parent of 54
the child authorizing the bureau to request a security freeze for 55
the child. The form under this paragraph (b) shall be made 56
available to parent of a child before the discharge of the child 57
and execution of the form shall be at the discretion of the parent 58
or parents of the child. 59
(c) For purposes of this subsection: 60
(i) The term "bureau" means the bureau of vital 61
statistics established under Section 41-57-1. 62
(ii) The term "health care facility" shall have 63
the meaning assigned in Section 41-7-173(h). 64
(iii) The term "security freeze" shall have the 65
meaning assigned in 15 USC § 1681c-1(i)(1)(C). 66
SECTION 3. This act shall take effect and be in force from 67
and after July 1, 2026. 68
