AN ACT TO EXPAND GUARANTEED ISSUE RIGHTS FOR MISSISSIPPIANS 1
TO APPLY FOR MEDICARE SUPPLEMENT POLICIES UPON LOSS OR VOLUNTARY 2

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. (1) Many Mississippi seniors are working past 6
the age of 65 and keeping their group coverage because without a 7
second income they cannot function economically on Social Security 8
only. It is the purpose of this act to provide Medicare-eligible 9
Mississippians with guaranteed issue rights to obtain a Medicare 10
supplement policy upon the loss, material reduction or voluntary 11
termination of creditable group health or Medicaid coverage, 12
without regard to fault or health status. 13
(2) The Mississippi Commissioner of Insurance shall 14
promulgate rules and regulations to require health insurance 15
companies in the State of Mississippi to offer Medicare-eligible 16
individuals with guaranteed issue rights to apply for a Medicare 17
supplement policy upon the loss, material reduction or voluntary 18
termination of creditable group health or Medicaid coverage 19

without regard to fault or health status and cannot deny the 20
application or charge more based upon the individual's health. 21
The commissioner shall require the transition from employer 22
coverage to Medicare Supplement coverage using guaranteed issue 23
rights. 24
SECTION 2. This act shall take effect and be in force from 25
and after July 1, 2026. 26
