AN ACT TO AMEND SECTION 17-15-1, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT ANY HUMAN RESOURCE AGENCY UNDER THIS CHAPTER PUBLICLY DISCLOSE THE AUTHORITY UNDER WHICH IT WAS CREATED, INCLUDING CITATION; TO REQUIRE THAT SUCH DISCLOSURE BE DISPLAYED IN A CLEAR AND CONSPICUOUS MANNER; TO STIPULATE THAT NOTICE OF A TORT CLAIM SHALL NOT BE SERVED UPON AN OFFICER, EMPLOYEE OR EXECUTIVE DIRECTOR OF SUCH AGENCY; TO PROVIDE FOR PROPER SERVICE; AND FOR RELATED PURPOSES.

DIRECTOR OF SUCH AGENCY; TO PROVIDE FOR PROPER SERVICE; AND FOR 7
RELATED PURPOSES. 8
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 9
SECTION 1. Section 17-15-1, Mississippi Code of 1972, is 10
amended as follows: 11
17-15-1. (1) The boards of supervisors and the municipal 12
governing boards of the various counties and cities of the State 13
of Mississippi are hereby empowered to create human resource 14
agencies which may be comprised of one or more counties, cities, 15
or any combination thereof. It is the express intention of this 16
chapter that agencies created hereunder shall be operated under 17
local governmental control and shall be responsible for 18
administration of programs heretofore conducted by community 19
action agencies, limited purpose agencies and related programs 20
authorized by federal law. 21

(2) (a) Any human resource agency created pursuant to this 22
chapter shall publicly disclose the statutory authority under 23
which it was created, including citation to the specific section 24
or sections of the Mississippi Code of 1972 authorizing its 25
formation. 26
(b) Such disclosure shall be displayed in a clear and 27
conspicuous manner on the agency's publicly accessible website, if 28
any, and on official publications, reports, or other 29
forward-facing materials distributed to the public. 30
(3) (a) For purposes of the Mississippi Tort Claims Act, 31
Section 11-46-1 et seq., Mississippi Code of 1972, notice of claim 32
against an agency created pursuant to this chapter shall not be 33
served upon an officer, employee or executive director of the 34
agency. 35
(b) If the agency was created or appointed by a county 36
or counties, notice shall be served upon the chancery clerk of the 37
county in which the principal offices of the agency are located. 38
(c) If the agency was created or appointed by a 39
municipality or municipalities, notice shall be served upon the 40
municipal clerk of the appointing municipality. 41
SECTION 2. This act shall take effect and be in force from 42
and after July 1, 2026. 43
