SENATE BILL NO. 2811
AN ACT TO PROHIBIT ANY PERSON FROM SHOOTING OR DISCHARGING 1
ANY FIREARMS ACROSS, OR IN, ANY PUBLIC ROAD IN THIS STATE, WITHIN 2
500 FEET OF ANY SCHOOL OR CHURCH, WITHIN 500 FEET OF ANY DWELLING 3
HOUSE, OR IN ANY STATE, COUNTY OR MUNICIPAL PARK IN AREAS OF WHICH 4
THE DISCHARGE OF FIREARMS IS PROHIBITED; TO DEFINE THE TERM 5
"DWELLING HOUSE"; TO PROVIDE EXCEPTIONS FOR PERSONS WHO ARE 6
RESIDENTS OR AUTHORIZED GUESTS OF A DWELLING HOUSE; TO PROVIDE 7
THAT VIOLATION OF THIS SECTION SHALL BE A MISDEMEANOR; TO PROVIDE 8
CRIMINAL PENALTIES; TO PROVIDE EXCEPTIONS FOR GUN REPAIR SHOPS, 9
FIREARM STORES, AND INDOOR SHOOTING RANGES; AND FOR RELATED 10
PURPOSES. 11
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. (1) As used in this section, the term "dwelling 13
house" means any building or structure used and occupied for human 14
habitation or intended to be so used, including, but not limited 15
to, residential houses, apartments or manufactured homes. The term 16
does not include the common law precept of curtilage. 17
(2) In addition to any other prohibitions which may exist by 18
other law, it shall be unlawful for any person to shoot or 19
discharge any firearms: 20
(a) Across or in any public road in this state, at any 21
time; 22

(b) Within five hundred (500) feet of any school or 23
church; or 24
(c) Within five hundred (500) feet of any dwelling 25
house unless the person who discharges a firearm under this 26
paragraph is a resident of a dwelling house, and or an authorized 27
guest of a dwelling house, and shoots or discharges a firearm in a 28
lawful manner within five hundred (500) feet of the dwelling house 29
where the person lives or is an authorized guest, if the firearm 30
is being discharged with the express or implied knowledge and 31
consent of all residents of that dwelling house, and no other 32
dwelling houses are located within five hundred (500) feet of 33
where the firearm is discharged; or 34
(d) In any state, county or municipal park in areas of 35
which the discharge of firearms is prohibited. 36
(3) Any person violating this section is guilty of a 37
misdemeanor and, upon conviction thereof, shall be fined not less 38
than Fifty Dollars ($50.00) nor more than Five Hundred Dollars 39
($500.00) or imprisoned in jail for not more than one hundred 40
(100) days, or both fined and imprisoned. 41
(4) Notwithstanding the provisions of subsection (2) of this 42
section, any person operating a gun repair shop or firearm store, 43
licensed to do business in the state and duly licensed under 44
applicable federal statutes, shall be exempt from the prohibition 45
established by this section for the purpose of test firing a 46
firearm. The director of the Department of Public Safety shall 47

prescribe the rules and regulations as may be necessary to carry 48
out the purposes of the exemption under this subsection and shall 49
ensure that any person residing in any dwelling house within five 50
hundred (500) feet of such gun repair shop or firearm store be 51
given an opportunity to protest the granting of such exemption. 52
(5) The provisions of this section are not applicable to 53
indoor shooting ranges the owner or operator of which holds all 54
necessary and required licenses where the shooting range is in 55
compliance with all applicable state, county, municipal laws, 56
rules or ordinances regulating the design and operation of such 57
facilities. 58
SECTION 2. This act shall take effect and be in force from 59
and after July 1, 2026. 60
