AN ACT TO AMEND SECTION 41-29-117, MISSISSIPPI CODE OF 1972, 1
TO ADD KRATOM TO SCHEDULE III OF THE UNIFORM CONTROLLED SUBSTANCES 2
ACT; AN ACT TO REPEAL SECTION 27-72-51, MISSISSIPPI CODE OF 1972, 3
WHICH PROVIDE AN EXCISE TAX ON THE SALE OF KRATOM PRODUCTS; TO 4
REPEAL SECTION 75-103-1 THROUGH 75-103-7, MISSISSIPPI CODE OF 5
1972, WHICH RELATE TO KRATOM PRODUCTS; AND FOR RELATED PURPOSES. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. Section 41-29-117, Mississippi Code of 1972, is 8
amended as follows: 9
41-29-117. (A) The controlled substances listed in this 10
section are included in Schedule III. 11
SCHEDULE III 12
(a) Stimulants. Any material, compound, mixture, or 13
preparation which contains any quantity of the following 14
substances or their salts, isomers, or salts of isomers, of the 15
following substances: 16
(1) Benzphetamine; 17
(2) Chlorphentermine; 18
(3) Clortermine; 19
(4) Phendimetrazine. 20

(b) Depressants. Unless listed in another schedule, 21
any material, compound, mixture, or preparation which contains any 22
quantity of the following substances: 23
(1) Any substance which contains any quantity of a 24
derivative of barbituric acid, or any salt of a derivative of 25
barbituric acid, except those substances which are specifically 26
listed in other schedules; 27
(2) Unless specifically excepted or unless listed 28
in another schedule, any compound, mixture or preparation 29
containing any of the following substances or any salt of the 30
substances specifically included in this subsection (2) and one or 31
more other active medicinal ingredients which are not listed in 32
any other schedule: 33
(i) Amobarbital; 34
(ii) Secobarbital; 35
(iii) Pentobarbital; 36
(3) Any suppository dosage form containing any of 37
the following substances or any salt of any of the substances 38
specifically included in this subsection (3) approved by the Food 39
and Drug Administration for marketing only as a suppository: 40
(i) Amobarbital; 41
(ii) Secobarbital; 42
(iii) Pentobarbital; 43
(4) Chlorhexadol; 44
(5) Embutramide; 45

(6) Any drug product containing 46
gamma-hydroxybutyric acid, including its salts, isomers and salts 47
of isomers, for which an application is approved under Section 505 48
of the Federal Food, Drug and Cosmetic Act; 49
(7) Ketamine; its salts, isomers, and salts of 50
isomers; other names include 51
(+)-2-(2-chlorophenyl)-2-(methylamino)cyclohexanone; 52
(8) Lysergic acid; 53
(9) Lysergic acid amide; 54
(10) Methyprylon; 55
(11) Perampanel; its salts, isomers, and salts of 56
isomers; 57
(12) Sulfondiethylmethane; 58
(13) Sulfonethylmethane; 59
(14) Sulfonmethane; 60
(15) Tiletamine and zolazepam or any salt thereof; 61
other names for the tiletamine and zolazepam combination product 62
include: telazol; other names for tiletamine include: 63
2-(ethylamino)-2-(2-thienyl)-cyclohexanone; other names for 64
zolazepam include: 4-(2-fluorophenyl)-6,8-dihydro 1,3, 65
8-trimethylpyrazolo-[3,4-e](1,4)-diazepin-7(1H)-one, flupyrazapon. 66
(c) Nalorphine. 67
(d) Any material, compound, mixture or preparation 68
which contains any quantity of ephedrine or pseudoephedrine, 69
except for any product that contains any quantity of 70

pseudoephedrine or ephedrine that is sold subject to the quantity 71
restrictions authorized in Section 73-21-124. 72
(e) Narcotic drugs. Any material, compound, mixture, 73
or preparation containing limited quantities of any of the 74
following narcotic drugs, or any salts thereof: 75
(1) Not more than one and eight-tenths (1.8) grams 76
of codeine, or any of its salts, per one hundred (100) milliliters 77
or not more than ninety (90) milligrams per dosage unit, with an 78
equal or greater quantity of an isoquinoline alkaloid of opium; 79
(2) Not more than one and eight-tenths (1.8) grams 80
of codeine, or any of its salts, per one hundred (100) milliliters 81
or not more than ninety (90) milligrams per dosage unit, with one 82
or more active, nonnarcotic ingredients in recognized therapeutic 83
amounts; 84
(3) Not more than one and eight-tenths (1.8) grams 85
of dihydrocodeine, or any of its salts, per one hundred (100) 86
milliliters or not more than ninety (90) milligrams per dosage 87
unit, with one or more active, nonnarcotic ingredients in 88
recognized therapeutic amounts; 89
(4) Not more than three hundred (300) milligrams 90
of ethylmorphine, or any of its salts, per one hundred (100) 91
milliliters or not more than fifteen (15) milligrams per dosage 92
unit, with one or more active, nonnarcotic ingredients in 93
recognized therapeutic amounts; 94

(5) Not more than five hundred (500) milligrams of 95
opium per one hundred (100) milliliters or per one hundred (100) 96
grams, or not more than twenty-five (25) milligrams per dosage 97
unit, with one or more active, nonnarcotic ingredients in 98
recognized therapeutic amounts; 99
(6) Not more than fifty (50) milligrams of 100
morphine, or any of its salts, per one hundred (100) milliliters 101
or per one hundred (100) grams with one or more active, 102
nonnarcotic ingredients in recognized therapeutic amounts. 103
(f) Anabolic steroids. Unless specifically exempted or 104
listed in another schedule, any material, compound, mixture or 105
preparation containing any quantity of any of the following 106
anabolic steroids (any drug or hormonal substance chemically and 107
pharmacologically related to testosterone other than estrogens, 108
progestins, corticosteroids and dehydroepiandrosterone): 109
(1) 3beta,17-dihydroxy-5a-androstane; 110
(2) 3alpha,17beta-dihydroxy-5a-androstane; 111
(3) 5alpha-androstan-3,17-dione; 112
(4) 1-androstenediol 113

species and that has been approved by the Secretary of Health and 242
Human Services for such administration. If any person prescribes, 243
dispenses, or distributes such steroid for human use, the person 244
shall be considered to have prescribed, dispensed or distributed 245
an anabolic steroid within the meaning of this paragraph. 246
(g) Any material, compound, mixture or preparation 247
which contains any quantity of buprenorphine or its salts. 248
(h) Dronabinol (synthetic) in sesame oil and 249
encapsulated in a soft gelatin capsule in a United States Food and 250
Drug Administration approved drug product. 251
(i) Any material, compound, mixture, or preparation 252
which contains any quantity of Tianeptine 253
(7-((3-chloro-6-methyl-5,5-dioxido-6,11-dihydrodibenzo[c,f][1,2]th254
iazepin-11-yl)amino)heptanoic acid) or its salts, isomers, salts 255
of isomers, sulfate, free acid or derivative thereof. 256
(j) Any material, compound, mixture, or preparation 257
which contains any quantity of mitragynine, commonly known as 258
kratom, (7 hydroxymitragynine) or its salts, isomers, salts of 259
isomers, sulfate, free acid or derivative thereof. 260
(B) Any material, compound, mixture or preparation which 261
contains any quantity of a Schedule III controlled substance other 262
than butalbital, and is listed as an exempt substance in 21 CFR, 263
Section 1308.22, 1308.24, 1308.26, 1308.32 or 1308.34, shall be 264
exempted from the provisions of the Uniform Controlled Substances 265
Law. 266

ST: Outlaw kratom.
SECTION 2. Sections 27-72-51, Mississippi Code of 1972, 267
which provide an excise tax on the sale of kratom products, is 268
hereby repealed. 269
SECTION 3. Sections 75-103-1, 75-103-3, 75-103-5, and 270
75-103-7, Mississippi Code of 1972, which relate to kratom 271
products, are hereby repealed. 272
SECTION 4. This act shall take effect and be in force from 273
and after July 1, 2026. 274
