BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 8
SECTION 1. Section 63-17-76, Mississippi Code of 1972, is 9
amended as follows: 10
63-17-76. (1) Every application for the issuance of a used 11
motor vehicle dealer's license shall be accompanied by such 12
evidence as the * * * Department of Revenue shall prescribe, 13
documenting the completion of an education seminar conducted by 14
the Mississippi Independent Auto Dealers Association during the 15
twelve-month period immediately preceding the date of application. 16
Completion of an eight-hour licensing seminar conducted by the 17
Mississippi Independent Auto Dealers Association shall be required 18
for an initial license. All seminars must be approved by 19

the * * * Department of Revenue. The education requirements of 20
this section shall not apply to: 21
(a) Used motor vehicle dealer, the primary business of 22
which is the sale of salvage vehicles on behalf of insurers; 23
(b) A manufactured home dealer; or 24
(c) A franchised new car dealer licensed under the 25
Mississippi Motor Vehicle Commission Law or any employee of such a 26
dealer. 27
(2) The Mississippi Independent Auto Dealers Association 28
shall submit to the * * * Department of Revenue a complete and 29
specific description of the seminars it conducts pursuant to this 30
section, a description of how the seminar will benefit licensees 31
in conducting their businesses, the number of hours involved, a 32
description of the method which will be used to ensure attendance, 33
and copies of any instructional materials which will be provided 34
to attendees. At the time approval is granted, the * * * 35
Department of Revenue shall determine how many hours of education 36
may be received by attending the program. 37
(3) Every renewal application for the issuance of a used 38
motor vehicle dealer's license shall be accompanied by such 39
evidence documenting the completion of a continuing education 40
course conducted by the Mississippi Independent Auto Dealers 41
Association preceding the date of the application. Renewal of a 42
license shall not be granted unless the licensee submits 43
satisfactory proof of at least six (6) hours of attendance at such 44

continuing education within twelve (12) months prior to renewal of 45
a license. At least one (1) hour of continuing education must be 46
related to titling and tags, and at least three (3) hours must be 47
onsite training. Upon completion of the seminar, the certificate 48
must be issued in the same name as the company employing the 49
instructors. 50
SECTION 2. This act shall take effect and be in force from 51
and after July 1, 2026. 52
