AN ACT MAKING AN APPROPRIATION FOR THE PURPOSE OF DEFRAYING 1
THE EXPENSES OF THE COMMISSION ON JUDICIAL PERFORMANCE OF THE 2
STATE OF MISSISSIPPI FOR THE FISCAL YEAR 2027. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 4
SECTION 1. The following sum, or so much thereof as may be 5
necessary, is hereby appropriated out of any money in the State 6
General Fund not otherwise appropriated, for the purpose of 7
defraying the expenses of the Commission on Judicial Performance 8
of the State of Mississippi for the fiscal year beginning 9
July 1, 2026, and ending June 30, 2027......... $ 1,018,805.00. 10
SECTION 2. The following sum, or so much thereof as may be 11
necessary, is hereby appropriated out of any money in the State 12
Treasury to the credit of the Commission on Judicial Performance, 13
for the purpose of defraying the expenses of the Commission on 14
Judicial Performance of the State of Mississippi for the fiscal 15
year beginning July 1, 2026, and ending June 30, 2027............. 16

SECTION 3. Of the funds appropriated under the provisions of 18
this act, the following positions are authorized: 19
AUTHORIZED HEADCOUNT: 20
Permanent: 6 21
Time-Limited: 0 22
Any transfers or escalations shall be made in accordance with 23
the terms, conditions and procedures established by law. 24
No general funds authorized to be expended herein shall be 25
used to replace federal funds and/or other special funds which are 26
being used for salaries authorized under the provisions of this 27
act and which are withdrawn and no longer available. 28
It is the intention of the Legislature that the salary of: 29
(a) The current director of the Judicial Performance 30
Commission shall not increase without specific authorization by 31
the Legislature; and 32
(b) Any person newly appointed as the director of the 33
Judicial Performance Commission shall not exceed the salary 34
authorized for a chancellor under Section 25-3-35, Mississippi 35
Code of 1972. 36
SECTION 4. It is the intention of the Legislature that the 37
Judicial Performance Commission shall maintain complete accounting 38
and personnel records related to the expenditure of all funds 39
appropriated under this act and that such records shall be in the 40
same format and level of detail as maintained for Fiscal Year 41
2026. It is further the intention of the Legislature that the 42

agency's budget request for Fiscal Year 2028 shall be submitted to 43
the Joint Legislative Budget Committee in a format and level of 44
detail comparable to the format and level of detail provided 45
during the Fiscal Year 2027 budget request process. 46
SECTION 5. It is the intention of the Legislature that 47
whenever two (2) or more bids are received by this agency for the 48
purchase of commodities or equipment, and whenever all things 49
stated in such received bids are equal with respect to price, 50
quality and service, the Mississippi Industries for the Blind 51
shall be given preference. A similar preference shall be given to 52
the Mississippi Industries for the Blind whenever purchases are 53
made without competitive bids. 54
SECTION 6. Of the funds appropriated in Section 1, One 55
Hundred Forty Thousand Dollars ($140,000.00) or so much thereof as 56
may be necessary is provided for the purpose of employing a 57
qualified attorney solely to audit, investigate, and monitor Youth 58
Courts operations. 59
SECTION 7. It is the intention of the Legislature that the 60
funds herein appropriated shall be expended in compliance with 61
Section 27-104-25, Mississippi Code of 1972, that no state agency 62
shall incur obligations or indebtedness in excess of their 63
appropriation and that the responsible officers, either personally 64
or upon their official bonds, shall be held responsible for 65
actions contrary to this provision. 66

SECTION 8. The money herein appropriated shall be paid by 67
the State Treasurer out of any money in the State Treasury to the 68
credit of the proper fund or funds as set forth in this act, upon 69
warrants issued by the State Fiscal Officer; and the State Fiscal 70
Officer shall issue his warrants upon requisitions signed by the 71
proper person, officer or officers, in the manner provided by law. 72
SECTION 9. This act shall take effect and be in force from 73
and after July 1, 2026. 74
