AN ACT MAKING AN APPROPRIATION TO DEFRAY THE EXPENSES OF THE 1
DEPARTMENT OF PUBLIC SAFETY FOR FISCAL YEAR 2027. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 3
SECTION 1. The following sum of money, or so much thereof as 4
may be necessary, is appropriated out of any money in the State 5
General Fund not otherwise appropriated, to defray the expenses of 6
the Department of Public Safety for the fiscal year beginning 7
July 1, 2026, and ending June 30, 2027......... $ 167,789,465.00. 8
SECTION 2. The following sum, or so much thereof as may be 9
necessary, is appropriated out of any money in the State Treasury 10
to the credit of the Department of Public Safety for the purpose 11
of defraying the expenses incurred in the operation of the various 12
divisions of the department for the fiscal year beginning 13
July 1, 2026, and ending June 30, 2027......... $ 112,997,879.00. 14
SECTION 3. Of the funds appropriated under the provisions of 15
this act, not more than the following amount of funds, with the 16
exception of the provisions in this section, shall be expended 17

only for "Personal Services," which includes "Vacancy Funding," 18
for the following authorized number of employment headcount: 19

As used in this section, the term "Personal Services" shall 33
mean funds provided under the major object of expenditure category 34
Personal Services for Salaries, Wages, and Fringe Benefits. Funds 35
in this category shall not be transferred to any other category. 36
It is the intention of the Legislature to ensure compliance 37
with the Variable Compensation Plan, as outlined in Section 38
25-9-147, Mississippi Code of 1972. Payment from these funds 39
shall be in accordance with the Variable Compensation Plan 40
promulgated by the Mississippi State Personnel Board. It is the 41
Legislature's intention that no employee's salary falls below the 42

minimum salary established by the Mississippi State Personnel 43
Board. 44
The State Personnel Board shall determine and publish the 45
projected annual cost of "Personal Services" based on monthly and 46
year-to-date payroll expenditures in compliance with the 47
provisions of this act. 48
With the funds herein appropriated, it shall be the agency's 49
responsibility to ensure that no single personnel action or 50
combination of personnel actions, when annualized, exceeds the 51
Fiscal Year 2027 appropriation for "Personal Services" with the 52
exception of escalated funds. Further, it shall be the agency's 53
responsibility to ensure that funds required to be appropriated 54
for "Personal Services" for Fiscal Year 2028 do not exceed Fiscal 55
Year 2027 funds appropriated for that purpose unless programs or 56
positions are added to the agency's Fiscal Year 2027 budget by the 57
Mississippi Legislature. 58
If, at the time the agency takes any action to change 59
"Personal Services," the State Personnel Board determines that the 60
agency has taken or will take an action that would cause the 61
agency to exceed the funds appropriated in this act when 62
annualized for Fiscal Year 2027 or increase the need for "Personal 63
Services" for Fiscal Year 2028, when annualized, the State 64
Personnel Board shall process no salary actions until such time as 65
the requirements of the provisions of this section are met with 66

the exception of new hires determined to be essential for the 67
agency. 68
When used in this section, "Vacancy Funding" shall mean funds 69
included in the Total Personal Services amount listed above and 70
designated for approved vacancies in Fiscal Year 2027. These 71
funds are to be utilized to increase the number of filled 72
headcounts that were authorized but unfilled as of the last day of 73
Fiscal Year 2026. If the agency fills additional headcounts after 74
March 1, 2026, until the end of Fiscal Year 2026, the amount of 75
available Vacancy Funding may be proportionally adjusted to 76
reflect the updated number of filled headcounts. The agency shall 77
be responsible for ensuring that "Vacancy Funding" is used to 78
increase headcounts and not for promotions, title changes, 79
in-range salary adjustments, or any other mechanism for increasing 80
salaries for current employees. 81
Any transfers or escalations shall be made in accordance with 82
the terms, conditions, and procedures established by law or 83
allowable under the terms set forth within this act. The State 84
Personnel Board shall not escalate positions or increase the 85
Personal Services total without written approval from the 86
Department of Finance and Administration. The Department of 87
Finance and Administration shall not provide written approval to 88
escalate any funds for salaries and/or headcounts without proof of 89
availability of new or additional funds above the appropriated 90
level. Unless specifically noted, all Fiscal Year 2026 escalated 91

headcounts have been accounted for and shall be converted to 92
authorized time-limited headcounts. 93
No general funds authorized to be expended herein shall be 94
used to replace federal funds and/or other special funds used for 95
salaries authorized under the provisions of this act and which are 96
withdrawn and no longer available. 97
None of the funds herein appropriated shall be used in 98
violation of the Internal Revenue Service's Publication 15-A 99
relating to the reporting of income paid to contract employees, as 100
interpreted by the Office of the State Auditor. 101
If the agency's total authorized headcount decreases from 102
Fiscal Year 2026 to Fiscal Year 2027, it will be the agency's 103
discretion as to what headcounts are removed. 104
The Legislature authorized three (3) new headcounts, which 105
are included in the authorized headcount above for Fiscal Year 106

SECTION 4. The Commissioner of Public Safety may, on a 111
case-by-case basis, within funds available, recommend that 112
corrective salary adjustments be made to the compensation of 113
employees of the Department of Public Safety where an inequity was 114
created between employees of equivalent capacity by previous 115
application of the agency appropriation acts. Any such corrective 116

salary adjustment plan must have prior approval by the State 117
Personnel Board. Such adjustments will not be retroactive. 118
Any funds in the Salary, Wages and Fringe Benefits major 119
object of expenditure may be used to purchase accumulated 120
compensatory time within funds available. 121
SECTION 5. It is the intention of the Legislature, that the 122
Department of Public Safety shall receive Five Million Dollars 123
($5,000,000.00) from the Mississippi Department of Transportation, 124
for the operations of the Office of Commercial Transportation 125
Enforcement Division that is authorized in Section 77-7-330, 126
Mississippi Code of 1972. 127
SECTION 6. It is the intent of the Legislature that the 128
local governments pay for part of the computer cost of the 129
Mississippi Justice Information Center by maintaining their 130
contribution to the Department of Public Safety. 131
SECTION 7. It is the intention of the Legislature that the 132
Department of Public Safety designate certain employees to aid the 133
Office of Forensics Laboratories in the billing and collecting of 134
all fees charged for services rendered by the Office of Forensics 135
Laboratories. 136
SECTION 8. No part of the funds appropriated herein shall be 137
transferred to, expended by, or used, directly or indirectly, for 138
the benefit of any public relations, publicity or publication 139
activities of any other state agency, department or officer, nor 140
shall any personnel paid with funds appropriated herein be 141

transferred or assigned to any other state agency, department or 142
officer for public relations, publicity, or publication activities 143
of such office. 144
SECTION 9. It is the intention of the Legislature that the 145
Department of Public Safety shall not issue citations for 146
violations of speed limits on a quota basis. No funds expended 147
under this act shall be used for such quota-based citations for 148
violations of speed limits. 149
SECTION 10. In compliance with the "Mississippi Performance 150
Budget and Strategic Planning Act of 1994," it is the intent of 151
the Legislature that the funds provided herein shall be utilized 152
in the most efficient and effective manner possible to achieve the 153
intended mission of this agency. Based on the funding authorized, 154
this agency shall make every effort to attain the targeted 155

SECTION 11. It is the intention of the Legislature that all 317
divisions within the Mississippi Department of Public Safety shall 318
maintain complete accounting and personnel records related to the 319
expenditure of all funds appropriated under this act and that such 320
records shall be in the same format and level of detail as 321
maintained for Fiscal Year 2026. It is further the intention of 322
the Legislature that the agency's budget request for Fiscal Year 323
2028 shall be submitted to the Joint Legislative Budget Committee 324
in a format and level of detail comparable to the format and level 325
of detail provided during the Fiscal Year 2027 budget request 326
process. 327
SECTION 12. Of the funds appropriated under the provisions 328
of Section 2 of this act, funds may be expended to defray the 329
costs of clothing for sworn nonuniform law enforcement officers in 330
an amount not to exceed One Thousand Dollars ($1,000.00) annually 331
per officer. 332
SECTION 13. It is the intention of the Legislature that 333
whenever two (2) or more bids are received by this agency for the 334
purchase of commodities or equipment, and whenever all things 335
stated in such received bids are equal with respect to price, 336
quality and service, the Mississippi Industries for the Blind 337
shall be given preference. A similar preference shall be given to 338
the Mississippi Industries for the Blind whenever purchases are 339
made without competitive bids. 340

SECTION 14. The department is authorized to expend available 341
funds on technology or equipment upgrades or replacements when it 342
will generate savings through efficiency or when the savings 343
generated from such upgrades or replacements exceed expenditures 344
thereof. 345
SECTION 15. Of the funds provided herein, and in addition to 346
the One Hundred Dollars ($100.00) authorized in Section 45-3-7, 347
Mississippi Code of 1972, Department of Public Safety Officers who 348
are licensed commercial pilots shall receive an additional Nine 349
Hundred Dollars ($900.00), for a total of One Thousand Dollars 350
($1,000.00), additional compensation for such service. 351
SECTION 16. It is the intention of the Legislature that the 352
Department of Public Safety shall provide an annual report to the 353
Mississippi Legislature detailing any elected official or any 354
other person who is not an employee of the Department of Public 355
Safety who was transported in Highway Patrol aircraft during the 356
fiscal year. The report shall be provided to each member of the 357
Mississippi Legislature on or before January 15, 2027. 358
SECTION 17. The Commissioner of Public Safety shall have the 359
authority to transfer any funds from any division within the 360
Department of Public Safety to any other division of the 361
Department of Public Safety Special Funds, including, but not 362
limited to, Funds 3711, 371C, 371E, 3713, 3714, 3715, 3740, 3741, 363
3742, 3744, 3747 and 3718, not to exceed Twenty Million Dollars 364
($20,000,000.00) collectively during Fiscal Year 2027. However, 365

none of the funds appropriated by this act shall be expended 366
unless the Department of Public Safety provides prior written 367
notification of any transfer of funds provided in this section. 368
SECTION 18. The Bureau of Narcotics is authorized to expend 369
a sum, not to exceed Five Hundred Thousand Dollars ($500,000.00) 370
from account No. 3371800000, for purposes of effectuating the 371
provisions of Section 41-29-179, Mississippi Code of 1972, Section 372
1 of this act. Expenditures authorized by this section may 373
include, but not be limited to, costs associated with contracting 374
with one or more vendors, contractors or other persons or entities 375
to create, operate and maintain the forfeiture website and to 376
provide continuing support in relation thereto. In the event an 377
amount less than Five Hundred Thousand Dollars ($500,000.00) is 378
required to effectuate the purposes of this section, the bureau is 379
authorized to expend the remainder of such authorized funds for 380
the purchase of commodities, vehicles and/or other equipment 381
necessary in the furtherance of the needs of the bureau. 382
SECTION 19. Of the funds appropriated in Section 1 of this 383
act, it is the intention of the Legislature that Four Million 384
Three Hundred Twelve Thousand Six Hundred Two Dollars 385
($4,312,602.00) may be allocated for the programs supported from 386
General Fund court assessments as follows: 387

SECTION 20. It is the intention of the Legislature that the 402
Mississippi Bureau of Narcotics, Mississippi Department of Public 403
Safety, shall have the authority to receive, budget and expend 404
special funds from the Drug Evidence Disposition Funds 405
(3372000000), not to exceed Five Hundred Thousand Dollars 406
($500,000.00). 407
SECTION 21. Of the funds appropriated by this act, pursuant 408
to Section 97-3-54.9, Mississippi Code of 1972, Two Hundred Fifty 409
Thousand Dollars ($250,000.00) is provided for the duties and 410
operations of a Statewide Human Trafficking Coordinator and a data 411
analyst within the Bureau of Investigation in the Department of 412
Public Safety, who shall coordinate all statewide activities and 413
work with the Department of Child Protection Services for all 414
victims recovered. 415

SECTION 22. Of the funds appropriated by this act, pursuant 416
to Section 45-1-2(7), Mississippi Code of 1972, Two Hundred 417
Forty-two Thousand Six Hundred Three Dollars ($242,603.00) is 418
provided for the duties and operations associated with the 419
Mississippi School Safety Act of 2019. 420
SECTION 23. The department may subgrant a portion of the 421
funds appropriated herein to the Jackson Police Department for 422
eligible activities contingent upon the execution of an 423
operational agreement between the Capitol Police and Jackson 424
Police Department on roles and responsibilities within the Capitol 425
Complex Improvement District. 426
SECTION 24. Of the funds appropriated in Section 1 of this 427
act, Nine Hundred Thousand Dollars ($900,000.00) is provided to 428
the Capitol Police for the purpose of defraying expenses related 429
to the housing of detainees arrested within the Capital Complex 430
Improvement District. 431
SECTION 25. The following sum, or so much thereof as may be 432
necessary, is reappropriated out of any money in the Capital 433
Expense Fund not otherwise appropriated, for the Department of 434
Public Safety for the purpose of reauthorizing the expenditure of 435
Capital Expense Funds as authorized in Senate Bill No. 2015, 2025 436
First Extraordinary Session, to the Department of Public Safety 437
for the fiscal year beginning July 1, 2026, and ending June 30, 438

Notwithstanding the amount reappropriated under this section, 451
the amount that may be expended under the authority of this 452
section shall not exceed the unexpended balance of the funds 453
remaining as of June 30, 2026, from the amount authorized for the 454
previous fiscal year. In addition, this reappropriation shall not 455
change the purpose for which the funds were originally authorized. 456
SECTION 26. It is the intention of the Legislature that the 457
Department of Public Safety shall obtain written, final 458
pre-approval from both the Department of Finance and 459
Administration and the Department of Archives and History, 460
including a notice of intent and detailed project plans submitted 461
in accordance with all applicable agency requirements, prior to 462
the advertisement, solicitation, receipt, or award of any bids for 463
the Capitol Security Platform funded in Section 25 of this act. 464
The Department of Archives and History shall review the project 465

for compliance with the Mississippi Landmark program and shall 466
issue a permit prior to any further action. Failure to obtain 467
such a permit shall prohibit the project from proceeding. No 468
state funds shall be expended, and no contracts shall be entered 469
into, until all required approvals have been obtained. The 470
project shall not proceed until the House Management Committee and 471
the Senate Rules Committee have approved the plans. Any material 472
change to the approved project scope, design, cost, or footprint 473
shall require resubmission and approval by all entities listed in 474
this section. 475
SECTION 27. With the funds appropriated herein, the 476
Department of Public Safety is authorized to make payments to 477
certain vendors for expenses incurred during Fiscal Years 2023 478
through 2024 in the following total amount.......... $ 14,339.90. 479
SECTION 28. The Mississippi Department of Public Safety may 480
escalate up to Ten Million Dollars ($10,000,000.00) in accordance 481
with the rules and regulations of the Department of Finance and 482
Administration, in a manner consistent with the escalation of 483
federal funds, along with the required documentation of the 484
overtime hours worked. If approved by the Department of Finance 485
and Administration, the Mississippi State Personnel Board may 486
update the authorized Personal Services amount to include these 487
escalations on the compliance reports. 488
SECTION 29. Of the funds appropriated in Section 2 of this 489
act, no more than Two Million Dollars ($2,000,000.00) is provided 490

for grants to law enforcement officers for enhanced training or 491
safety equipment as created in 45-2-1, Mississippi Code of 1972. 492
SECTION 30. Of the funds appropriated under the provisions 493
of Section 2 of this act Two Hundred Seventy-eight Thousand 494
Dollars ($278,000.00), or so much thereof, shall be derived out of 495
any money in the State Treasury to the credit of the Capital 496
Expense Fund, as created in Section 27-103-303, Mississippi Code 497
of 1972, and allocated in a manner as determined by the State 498
Treasurer. These funds are provided to the Mississippi Department 499
of Public Safety for repairs and renovations to the Mississippi 500
Law Enforcement Officers' Training Academy campus. 501
SECTION 31. Of the funds appropriated under the provisions 502
of Section 2 of this act, One Hundred Eighty Thousand Dollars 503
($180,000.00), or so much thereof, shall be derived out of any 504
money in the State Treasury to the credit of the Capital Expense 505
Fund, as created in Section 27-103-303, Mississippi Code of 1972, 506
and allocated in a manner as determined by the State Treasurer. 507
These funds are provided to the Mississippi Department of Public 508
Safety for the purchase of three (3) FARO 3D Imaging Units. 509
SECTION 32. Of the funds appropriated under the provisions 510
of Section 2 of this act, Two Million Six Hundred Thousand Dollars 511
($2,600,000.00), or so much thereof as may be necessary, shall be 512
derived out of any money in the State Treasury to the credit of 513
the Capital Expense Fund, as created in Section 27-103-303, 514
Mississippi Code of 1972, and allocated in a manner as determined 515

by the State Treasurer. These funds are provided to the 516
Mississippi Department of Public Safety for repair and replacement 517
of the HVAC systems at the Biloxi Forensics Laboratory. 518
SECTION 33. The money herein appropriated shall be paid by 519
the State Treasurer out of any money in the State Treasury to the 520
credit of the proper fund or funds as set forth in this act, upon 521
warrants issued by the State Fiscal Officer; and the State Fiscal 522
Officer shall issue his warrants upon requisitions signed by the 523
proper person, officer or officers, in the manner provided by law. 524
SECTION 34. This act shall take effect and be in force from 525
and after July 1, 2026. 526
