BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. The following sum, or so much of it as may be 6
necessary, is reappropriated out of any money in the Coronavirus 7
State Fiscal Recovery Fund not otherwise appropriated, to the 8
Office of Workforce Development, with the Department of Employment 9
Security serving as the fiscal agent, as authorized in House Bill 10
No. 1517, 2022 Regular Session, Senate Bill No. 3052, 2023 Regular 11
Session, Senate Bill No. 3113, 2023 Regular Session, Senate Bill 12
No. 3058, 2024 Regular Session, and Senate Bill No. 2048, 2025 13
First Extraordinary Session, for the fiscal year beginning July 1, 14
2026, and ending October 15, 2026.............. $ 16,122,511.00. 15
Notwithstanding the amount reappropriated under this section, 16

State Fiscal Recovery Fund not otherwise appropriated, to the 22
Department of Environmental Quality, as authorized in Senate Bill 23
No. 3056, 2022 Regular Session, House Bill No. 1716, 2023 Regular 24
Session, Senate Bill No. 3052, 2023 Regular Session, Senate Bill 25
No. 3058, 2024 Regular Session, and Senate Bill No. 2048, 2025 26
First Extraordinary Session, for the purpose of administering the 27
Mississippi Municipality and County Water Infrastructure (MCWI) 28
Grant Program established in Section 49-2-131, Mississippi Code of 29
1972, for the fiscal year beginning July 1, 2026, and ending 30
October 15, 2026................................ $ 181,000,000.00. 31
Notwithstanding the amount reappropriated under this section, 32
in no event shall the amount expended exceed the unexpended 33

providing funds to destination marketing organizations to assist 44

funds to Mississippi Main Street Association, as provided in 46

Notwithstanding the amount reappropriated under this section, 50

necessary, is reappropriated out of any money in the Mississippi 55
Association of Independent Colleges and Universities (MAICU) Grant 56
Program Fund not otherwise appropriated, to the Department of 57
Finance and Administration, as authorized in Senate Bill No. 3064, 58
2022 Regular Session, Senate Bill No. 3052, 2023 Regular Session, 59
Senate Bill No. 3058, 2024 Regular Session, and Senate Bill No. 60
2048, 2025 First Extraordinary Session, for the purpose of funding 61
the MAICU Grant Program established in Section 37-185-31, 62
Mississippi Code of 1972, for the fiscal year beginning July 1, 63
2026, and ending October 15, 2026............... $ 2,107,146.00. 64
Notwithstanding the amount reappropriated under this section, 65
in no event shall the amount expended exceed the unexpended 66
balance of the funds remaining as of June 30, 2026, or change the 67

State Department of Health, as authorized in House Bill No. 1614, 72

2048, 2025 First Extraordinary Session, for the purpose of 75
operational expenditures needed to respond to the COVID-19 76
pandemic as allowable under Section 9901 of the American Rescue 77
Plan Act of 2021 (ARPA) or any guidance or regulation issued by 78
the United States Department of the Treasury in conformity 79
therewith, for the fiscal year beginning July 1, 2026, and ending 80
October 15, 2026................................ $ 241,128.00. 81
Notwithstanding the amount reappropriated under this section, 82

Session, Senate Bill No. 3058, 2024 Regular Session, and Senate 157
Bill No. 2048, 2025 First Extraordinary Session, for the purpose 158
of assisting with behavioral and mental health needs exacerbated 159
by the Coronavirus Disease 2019 (COVID-19) pandemic, responding to 160
other public health impacts, and other operational expenses as 161
allowed under Section 9901 of the American Rescue Plan Act of 2021 162
(ARPA) or any guidance or regulation issued by the United States 163
Department of the Treasury in conformity therewith, for the fiscal 164
year beginning July 1, 2026, and ending October 15, 2026.......... 165

Senate Bill No. 3052, 2023 Regular Session, Senate Bill No. 3058, 176
2024 Regular Session, and Senate Bill No. 2048, 2025 First 177
Extraordinary Session, for the purpose of eligible infrastructure 178
projects for the fiscal year beginning July 1, 2026, and ending 179
October 15, 2026................................ $ 711,079.00. 180
Notwithstanding the amount reappropriated under this section, 181
in no event shall the amount expended exceed the unexpended 182
balance of the funds remaining as of June 30, 2026, or change the 183

SECTION 12. The following sum, or so much of it as may be 185
necessary, is reappropriated out of any money in the Coronavirus 186
State Fiscal Recovery Fund not otherwise appropriated, to the 187
Department of Public Safety, as authorized in Senate Bill No. 188
3014, 2022 Regular Session, Senate Bill No. 3052, 2023 Regular 189
Session, Senate Bill No. 3058, 2024 Regular Session, and Senate 190
Bill No. 2048, 2025 First Extraordinary Session, for the purpose 191
of completing capital projects at state-owned buildings or 192
grounds, crime prevention due to the increase in crime, and 193

backlogs at the Forensic Laboratory, necessary to respond to the 195

regulation issued by the United States Department of the Treasury 198
in conformity therewith, for the fiscal year beginning July 1, 199
2026, and ending October 15, 2026............... $ 575,000.00. 200
Notwithstanding the amount reappropriated under this section, 201
in no event shall the amount expended exceed the unexpended 202
balance of the funds remaining as of June 30, 2026, or change the 203
purpose for which the funds were originally authorized. 204
SECTION 13. The following sum, or so much of it as may be 205
necessary, is reappropriated out of any money in the Coronavirus 206
State Fiscal Recovery Fund not otherwise appropriated, to the 207
District Attorney's and staff, as authorized in House Bill No. 208
1625, 2022 Regular Session, Senate Bill No. 2961, 2023 Regular 209
Session, Senate Bill No. 3052, 2023 Regular Session, Senate Bill 210
No. 3058, 2024 Regular Session, and Senate Bill No. 2048, 2025 211
First Extraordinary Session, for the purpose of funding additional 212
salaries and office expenses of temporary legal assistants and 213
support personnel as authorized by Section 25-31-5(2)(g), 214
Mississippi Code of 1972, necessary to respond to the effects of 215
the COVID-19 pandemic as allowable under Section 9901 of the 216
American Rescue Plan Act of 2021 (ARPA) or any guidance or 217
regulation issued by the United States Department of the Treasury 218

the purpose of defraying the cost of eligible expenditures under 231
the American Rescue Plan Act, for the fiscal year beginning July 232

SECTION 17. The following sum, or so much of it as may be 269
necessary, is reappropriated out of any money in the Coronavirus 270
State Fiscal Recovery Fund not otherwise appropriated, to the 271
Mississippi Department of Transportation, as authorized in House 272
Bill No. 1826, 2024 Regular Session and Senate Bill No. 2048, 2025 273
First Extraordinary Session, for the purpose of defraying the cost 274
of allowable Surface Transportation projects included in the 275
Maintenance Program of the MDOT Three-Year Plan, for the fiscal 276
year beginning July 1, 2026, and ending June 30, 2027............. 277

Notwithstanding the amount reappropriated under this section, 279
in no event shall the amount expended exceed the unexpended 280
balance of the funds remaining as of June 30, 2026, or change the 281
purpose for which the funds were originally authorized. 282
SECTION 18. None of the funds reappropriated in this act 283
shall be used to pay employee premium payments. 284
SECTION 19. (1) As used in this section, the term "agency" 285
shall mean the entities in which funds were reappropriated in 286
Sections 1 through 17 of this act. 287
(2) The agency shall not disburse any funds provided under 288
this section to any recipient without first: (a) making an 289
individualized determination that the expenditure sought is, in 290
the agency's independent judgment, for necessary expenditures 291
eligible under Section 602 of the federal Social Security Act as 292
added by Section 9901 of the federal American Rescue Plan Act of 293

2021 (ARPA) and its implementing guidelines, guidance, rules, 294
regulations and/or other criteria, as may be amended or 295
supplemented from time to time, by the United States Department of 296
the Treasury; and (b) determining that the recipient has not 297
received and will not receive reimbursement for the expense in 298
question from any source of funds, including insurance proceeds, 299
other than those funds provided under Section 602 of the federal 300
Social Security Act as added by Section 9901 of ARPA. In 301
addition, the agency shall ensure that all funds provided under 302
this section are disbursed in compliance with the Single Audit Act 303
(31 USC §§ 7501-7507) and the related provisions of the Uniform 304
Guidance, 2 CFR Section 200.303 regarding internal controls, 305
Sections 200.330 through 200.332 regarding sub-recipient 306
monitoring and management, and subpart F regarding audit 307
requirements. 308
(3) As a condition of receiving and expending the funds 309
provided to the agency under this section, the agency shall 310
certify to the Department of Finance and Administration that each 311
expenditure of the funds provided to the agency under this section 312
complies with the guidelines, guidance, rules, regulations and/or 313
other criteria, as may be amended from time to time, of the United 314
States Department of the Treasury regarding the use of monies from 315
the Coronavirus State Fiscal Recovery Fund established by ARPA. 316
(4) If the Office of Inspector General of the United States 317
Department of the Treasury, or the Office of Inspector General of 318

any other federal agency having oversight over the use of monies 319
from the Coronavirus State Fiscal Recovery Fund established by 320
ARPA (a) determines that the agency or recipient has expended or 321
otherwise used any of the funds provided to the agency under this 322
section for any purpose that is not in compliance with the 323
guidelines, guidance, rules, regulations and/or other criteria, as 324
may be amended from time to time, of the United States Department 325
of the Treasury regarding the use of monies from the Coronavirus 326
State Fiscal Recovery Fund established by the ARPA, and (b) the 327
State of Mississippi is required to repay the federal government 328
for any of those funds that the Office of the Inspector General 329
determined were expended or otherwise used improperly by the 330
agency or recipient, then the agency or recipient that expended or 331
otherwise used those funds improperly shall be required to pay the 332
amount of those funds to the State of Mississippi for repayment to 333
the federal government. 334
SECTION 20. The money appropriated by this act shall be paid 335
by the State Treasurer out of any money in the State Treasury to 336
the credit of the proper fund or funds as set forth in this act, 337
upon warrants issued by the State Fiscal Officer; and the State 338
Fiscal Officer shall issue his or her warrants upon requisitions 339
signed by the proper person, officer or officers in the manner 340
provided by law. 341
SECTION 21. This act shall take effect and be in force from 342
and after July 1, 2026. 343
