SENATE BILL NO. 3253

AN ACT MAKING AN APPROPRIATION TO THE DEPARTMENT OF EDUCATION 1
TO DEFRAY COSTS ASSOCIATED WITH SENSORY SUPPORTS, ROOMS OR 2
EQUIPMENT, FOR STUDENTS WHOSE INDIVIDUALIZED EDUCATION PROGRAM OR 3
504 PLAN IDENTIFIES A NEED IN ORDER TO ENSURE ACCESS TO EDUCATION 4
FOR THE FISCAL YEAR 2027. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. The following sum, or so much of it as may be 7
necessary, is appropriated out of any money in the State General 8
Fund not otherwise appropriated, to the Department of Education to 9
defray costs associated with sensory supports, rooms or equipment, 10
for students whose Individualized Education Program or 504 Plan 11
identifies a need in order to ensure access to education, for the 12
fiscal year beginning July 1, 2026, and ending June 30, 2027...... 13

SECTION 2. As a condition of receiving and expending the 15
funds appropriated to the Department of Education under this act, 16
the Department of Education shall promulgate and enforce 17
reasonable rules and regulations to require public school 18
districts to provide the accommodations described in Section 1 of 19

this act using best practices to guide the design, supervision and 20
evaluation of school facilities to meet individual student needs. 21
SECTION 3. The money appropriated by this act shall be paid 22
by the State Treasurer out of any money in the State General Fund 23
not otherwise appropriated, upon warrants issued by the State 24
Fiscal Officer; and the State Fiscal Officer shall issue his or 25
her warrants upon requisitions signed by the proper person, 26
officer or officers in the manner provided by law. 27
SECTION 4. This act shall take effect and be in force from 28
and after July 1, 2026. 29
