SENATE BILL NO. 3407

AN ACT TO AMEND CHAPTER 911, LOCAL AND PRIVATE LAWS OF 1989, 1
TO REVISE THE POWERS AND DUTIES OF THE COUNTY FAIR BOARD OF 2
JACKSON COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 4
SECTION 1. Chapter 911, Local and Private Laws of 1989, is 5
amended as follows: 6
Section 1. The Board of Supervisors of Jackson County, 7
Mississippi, is hereby authorized, in its discretion, to create a 8
county fair board and to appoint five (5) members thereto. Each 9
member of the county fair board shall be a qualified elector of 10
the county and there shall be one (1) member from each 11
supervisor's district. The terms of the members shall be 12
concurrent with the terms of members of the board of supervisors 13
and each member shall receive a per diem for each meeting attended 14
as may be provided by the board of supervisors. The fair board 15
shall elect one (1) of its members to serve as chairman and one 16
(1) other member to serve as * * * secretary. The board of 17
supervisors shall have the power to remove any member of the 18

county fair board for inefficiency, incompetency or for any other 19
cause. 20
Section 2. The Board of Supervisors of Jackson County may 21
annually allocate * * * such funds as the board of supervisors, in 22
its discretion, determines necessary to properly promote, plan, 23
organize and implement a county fair or fairs, including 24
competitive events, carnival-type shows and other activities 25
normally associated with county fairs, the farmers' market and 26
related activities. The county fair board may promulgate and 27
recommend to the board of supervisors rules and regulations 28
relating to the use of the county fairground facilities and may, 29
if the board of supervisors approves such rules and regulations, 30
implement and enforce such rules and regulations. * * * 31
The fair board * * * shall have authority to make all 32
contracts in relation * * * to the county fair and the fair 33
facilities. 34
The fair board shall have authority to establish bylaws for 35
the holding and conducting of its meetings and to promulgate such 36
rules and regulations as it deems necessary for the safe, economic 37
and efficient management of the county fair and related activities 38
for all the citizens of the county. 39
Section 3. The county fair board shall have authority, 40
subject to approval by the board of supervisors, to employ such 41
advisory and/or administrative staff to be selected equally from 42
each supervisor's district and may employ, subject to approval by 43

the board of supervisors, such additional employees as may be 44
necessary to conduct fair activities * * *. The county fair board 45
shall have the right * * * to direct * * * employees in the 46
discharge of their duties and to discharge staff and employees for 47
inefficiency or for other good cause. * * * 48
The county fair board shall have the power to operate 49
concessions and use fairground facilities for the sale of soft 50
drinks, confections, popcorn, peanuts or similar items and may 51
charge and collect fees and lease buildings and fairground 52
facilities to others for such purposes as set forth by the board 53
of supervisors. 54
Section 4. * * * The county fair board may also serve as a 55
recommending body to the board of supervisors regarding the use of 56
the fairgrounds for large-scale events or promotions. 57
Section 5. * * * The fair board shall annually make a 58
detailed statement covering the * * * annual Jackson County Fair 59
or other activities at the fairground facilities and may make any 60
recommendations which it may have for further development of the 61
fairgrounds. 62
Section 6. This act shall be liberally construed to promote 63
the efficient operation of the fair and the fairground facilities 64
of the county to the end that all activities of the county fair 65
board result in the improvement of all activities conducted for 66
all citizens of the county. 67

Section 7. The board of supervisors is hereby authorized and 68
empowered to set aside, appropriate and expend moneys from the 69
county general fund for the purpose of conducting, supporting and 70
maintaining all fair and fairground activities and facilities in 71
the county, and the funds so appropriated shall be used for no 72
purpose except as provided in this act. 73
SECTION 2. This act shall take effect and be in force from 74
and after its passage. 75
