A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE 1
MISSISSIPPI CONSTITUTION OF 1890 TO REQUIRE ALL CANDIDATES RUNNING 2
FOR STATE AND COUNTY ELECTIONS TO SECURE THE MAJORITY VOTE TO BE 3
ELECTED; AND FOR RELATED PURPOSES. 4
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF 5
MISSISSIPPI, That the following amendment to the Mississippi 6
Constitution of 1890 is proposed to the qualified electors of the 7
state: 8
Amend Section 102, Mississippi Constitution of 1890, to read 9
as follows: 10
Section 102. All general elections for state and county 11
officers shall commence and be * * * held every four (4) years, on 12
the first Tuesday after the first Monday in November, until 13
altered by the law * * *. The candidates who receive a majority 14
of the number of votes cast in the election for these state and 15
county offices, shall be declared elected. If no candidate 16
receives a majority number of votes cast in the election, then a 17
runoff election shall be held pursuant to the procedures provided 18
in the Mississippi Election Code. The electors, in all cases 19

except in cases of treason, felony, and breach of peace, shall be 20
privileged from arrest during their attendance at elections and in 21
going to and returning therefrom. 22
BE IT FURTHER RESOLVED, That this proposed amendment shall be 23
submitted by the Secretary of State to the qualified electors at 24
the election to be held on the first Tuesday after the first 25
Monday of November 2026, as provided by Section 273 of the 26
Constitution and by general law. 27
BE IT FURTHER RESOLVED, That the explanation of this proposed 28
amendment for the ballot shall read as follows: "This proposed 29
constitutional amendment requires that all state- and 30
county-elected officials secure a majority of the number of votes 31
cast in an election to be declared elected." 32
