SENATE RESOLUTION NO. 18
A RESOLUTION CALLING UPON MISSISSIPPI LOCAL LAW ENFORCEMENT 1
ENTITIES TO ENTER INTO 287(g) AGREEMENTS RELATING TO IMMIGRATION 2
ENFORCEMENT. 3
WHEREAS, President Donald J. Trump noted in Executive Order 4
14159, "Protecting the American People Against Invasion": 5
"Over the last four years, the prior administration invited, 6
administered, and oversaw an unprecedented flood of illegal 7
immigration into the United States. Millions of illegal aliens 8
crossed our borders or were permitted to fly directly into the 9
United States on commercial flights and allowed to settle in 10
American communities, in violation of longstanding federal laws. 11
Many of these aliens unlawfully within the United States present 12
significant threats to national security and public safety, 13
committing vile and heinous acts against innocent Americans. 14
Others are engaged in hostile activities, including espionage, 15
economic espionage, and preparations for terror-related 16
activities. Many have abused the generosity of the American 17

people, and their presence in the United States has cost taxpayers 18
billions of dollars at the federal, state, and local levels. 19
Enforcing our Nation's immigration laws is critically important to 20
the national security and public safety of the United States"; and 21
WHEREAS, the Illegal Immigration Reform and Immigrant 22
Responsibility Act of 1996 added Section 287(g) to the Immigration 23
and Nationality Act (INA) — authorizing U.S. Immigration and 24
Customs Enforcement (ICE) to delegate to state and local law 25
enforcement officers the authority to perform specified 26
immigration officer functions under the agency's direction and 27
oversight; and 28
WHEREAS, the 287(g) Program enhances the safety and security 29
of our nation's communities by allowing ICE Enforcement and 30
Removal Operations (ERO) to partner with state and local law 31
enforcement agencies to identify and remove criminal aliens; and 32
WHEREAS, the 287(g) Program allows ICE — through the 33
delegation of specified immigration officer duties — to enhance 34
collaboration with state and local law enforcement partners to 35
protect American residents through the arrest and removal of 36
aliens who undermine the safety of our nation's communities and 37
the integrity of U.S. immigration laws; and 38
WHEREAS, specifically, ICE Enforcement and Removal Operations 39
operates three 287(g) models: 40
(a) The Jail Enforcement Model, which is designed to 41
identify and process removable aliens — with criminal or pending 42

criminal charges — arrested by state or local law enforcement 43
agencies; 44
(b) The Task Force Model, which serves as a force 45
multiplier for law enforcement agencies to enforce limited 46
immigration authority with ICE oversight during their routine 47
police duties; 48
(c) The Warrant Service Officer Program, which allows 49
ICE to train, certify and authorize state and local law 50
enforcement officers to serve and execute administrative warrants 51
on aliens in their agency's jail; and 52
WHEREAS, Executive Order 14159 requires ICE to authorize 53
state and local law enforcement officials, as the Secretary of 54
Homeland Security determines are qualified and appropriate, under 55
Section 287(g) of the Immigration and Nationality Act to "perform 56
the functions of immigration officers in relation to the 57
investigation, apprehension, or detention of aliens in the United 58
States under the direction and the supervision of the Secretary of 59
Homeland Security"; and 60
WHEREAS, countering the grave threat posed by the illegal 61
immigration crisis requires that local law enforcement agencies 62
cooperate with the federal government in the enforcement of 63
immigration law: 64
NOW, THEREFORE, BE IT RESOLVED by the members of the 65
Mississippi Senate, that the Senate calls upon all of 66
Mississippi's local law enforcement entities to enter into 287(g) 67

ST: Urge local law enforcement to enter into
immigration enforcement agreements.
agreements with ICE to protect our communities against the threat 68
posed by illegal, criminal aliens. 69
BE IT FURTHER RESOLVED, That the Secretary of the Senate is 70
hereby authorized and directed to transmit a copy of this 71
resolution to all local law enforcement entities in the State of 72
Mississippi and make available to the Capitol Press Corps. 73
