AN ACT
T o repeal section 315.005, RSMo, and to enact in lieu thereof two new sections relating to
human traff icking awareness training.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 315.005, RSMo, is repealed and two new sections enacted in lieu
2 thereof, to be known as sections 315.005 and 315.085, to read as follows:
315.005. As used in sections 315.005 to 315.065, unless the context clearly indicates
2 otherwise, the following terms mean:
3 (1) "Code", the standards relating to fire safety , sanitation, electrical wiring, fuel-
4 burning appliances, plumbing, swimming pools and spas, sewage and waste treatment and
5 disposal as adopted by the department. The department in its discretion, may incorporate, in
6 whole or in part, the standards or codes promulgated by the National Fire Protection
7 Association, Building Of ficials and Code Administration International, Inc., Great Lakes
8 Upper Mississippi River Board of State Sanitary Engineers, and American Society of Sanitary
9 Engineers;
10 (2) "Department", the director of the department of health and senior services or an
11 agent of the director of the department of health and senior services;
12 (3) "Guest room", any room or unit where sleeping accommodations are regularly
13 furnished to the public;
14 (4) "Hosting platform", an electr onic platform used by a rent al operator to
15 advertise or facilitate the ren tal of a short-term rent al;

16 (5) "Human trafficking", the use of for ce, fraud, or coer cion to obtain some type
17 of labor or commer cial sex act as defined in 22 U.S.C. Section 7102 and the commission
18 of an offense established under sections 566.200 to 566.223;
19 (6) "Human trafficking awar eness training", training established or appr oved
20 by the department that includes, but is not limited to, the following components:
21 (a) The definition of human trafficking and commer cial exploitation of children;
22 (b) Guidance on how to identify persons at risk for trafficking;
23 (c) Guidance on how to identify the signs of trafficking and persons potentially
24 engaged in the act of trafficking;
25 (d) Differen ces between labor and sex trafficking, specific to the hotel sector;
26 (e) Guidance on the ro le of hospitality employees in rep orting and r esponding to
27 instances of human trafficking; and
28 (f) Contact information for the national human trafficking hotline toll-free
29 number and text line and contact information for the local law enfor cement agency .
30 (7) "Lodging establishment", any building, group of buildings, structure, facility ,
31 place, or places of business where five or more guest rooms are provided, which is owned,
32 maintained, or operated by any person and which is kept, used, maintained, advertised or held
33 out to the public for hire which can be construed to be a hotel, motel, motor hotel, apartment
34 hotel, tourist court, resort, cabins, tourist home, bunkhouse, dormitory , or other similar place
35 by whatever name called, and includes all such accommodations operated for hire as lodging
36 establishments for either transient guests, permanent guests, or for both transient and
37 permanent guests;
38 [ (5) ] (8) "Owner", the person responsible for obtaining a license from the department
39 for operating the lodging establishment;
40 [ (6) ] (9) "Permanent guest", any person who rents and occupies a guest room in a
41 lodging establishment for a period of thirty-one days or more;
42 [ (7) ] (10) "Person", any individual, partnership, corporation, association,
4 3 or ganization, firm, or federal, state, county , city , village, or municipal association or
44 corporation;
45 (1 1) "Short-term rent al pr operty", res idential or multifamily prop erty used or
46 offer ed for ren t for transient guest use thr ough a hosting platform;
47 [ (8) ] (12) "T ransient guest", any person who rents and occupies a guest room in a
48 lodging establishment for a period of less than thirty-one days.
315.085. 1. Every employee of a lodging establishment and every operator of a
2 short-term r ental pr operty in this state shall be r equir ed to receive human trafficking
3 awar eness training within one-hundr ed-eighty days of employment or the first listing of
4 a short-term ren tal prop erty on a hosting platform, and after the first year of

5 employment or listing, annual human trafficking awaren ess training not later than
6 December thirty-first.
7 2. Every operator of a lodging establishment or short-term r ental pr operty in
8 this state shall implement proced ures and adopt policies for the rep orting of suspected
9 human trafficking to the national human trafficking hotline or to a local law
10 enfor cement agency .
11 3. Any person who operates a lodging establishment or short-term rent al
12 pr operty shall maintain record s of employee or operator training. Such r ecords shall be
13 kept on file by the operator of the lodging establishment or short-term r ental pr operty
14 for the period during which the employee is employed by the establishment or the
15 operator manages the short-term r ental pr operty listing, and for one year after such
16 employment or operation ends. A lodging establishment or short-term ren tal pr operty
17 operator shall pr ovide record s to the department within a r easonable amount of time,
18 but no later than ten business days, after such req uest is made in writing.
