AN ACT
T o repeal section 161.020, RSMo, and to enact in lieu thereof one new section relating to
education reforms.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 161.020, RSMo, is repealed and one new section enacted in lieu
2 thereof, to be known as section 161.020, to read as follows:
161.020. 1. There is hereby created a department of elementary and secondary
2 education headed by a state board of education as provided in Article IX, Constitution of
3 Missouri, and chapter 161 and others. The state board shall appoint a commissioner of
4 education as the chief administrative of ficer of the department.
5 2. The department of education, chapter 161 and others, is abolished and its powers,
6 duties, personnel and property are transferred as provided in this act.
7 3. The division of public schools of the department of education, chapter 161 and
8 others, is abolished and its powers, duties, personnel and property , with exceptions specified
9 elsewhere in this act, are transferred by type I transfer to the department of elementary and
10 secondary education.
11 4. The Missouri School for the Deaf, chapter 178 and others, and the Missouri School
12 for the Blind, chapter 178 and others, are transferred to the department of elementary and
13 secondary education by a type I transfer . The commissioner of education shall appoint
14 superintendents for these schools and members of the advisory boards, provided in chapter
15 178 and others.
16 5. (1) As used in this subsection, the following terms mean:
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
17 (a) "Committee", the quality contro l committee for oversight established in this
18 subsection;
19 (b) "Department", the Missouri department of elementary and secondary
20 education;
21 (c) "Educational entity", any of the following:
22 a. A charter school as described in section 160.400;
23 b. An entity that prov ides early childhood education services as defined in
24 section 161.244;
25 c. An FPE school as defined in section 167.013;
26 d. A home school as defined in section 167.012;
27 e. A private school;
28 f. A public or private virtual school;
29 g. A public school as defined in section 160.01 1; or
30 h. A school district as defined in section 160.01 1;
31 (d) "Key performance indicators" or "KPI", the indicators of success in the
32 accomplishment of the department's mission as assessed and repo rted on by the
33 committee, which indicators include, but ar e not limited to, a graduated student's ability
34 to:
35 a. Show up on time;
36 b. Be res pectful and kind;
37 c. Follow instructions;
38 d. W ork hard;
39 e. Demonstrate initiative; and
40 f. Demonstrate discernment.
41 (2) (a) The mission of the department is her eby declar ed to be to prod uce
42 graduates who contribute positively to the economy and their communities.
43 (b) The department's mission shall apply to all educational entities. Each
44 educational entity shall demonstrate how the department's mission is rei nforced in the
45 educational entity's curricula and graduation req uirements .
46 (c) The department's mission shall be incorporated into and thr oughout existing
47 curricula.
48 (d) Each educational entity that is a high school shall ensur e that each
49 graduating student meets all KPIs before granting such student's diploma or high
50 school equivalency (HSE) certificate.
51 (3) The department shall have the following duties in connection with this
52 subsection:

53 (a) Developing pro cesses for use by educational entities to meet obligations
54 under this section and committee requ irem ents;
55 (b) Implementing quality control systems and methods as defined, designed, or
56 dir ected by the committee;
57 (c) Establishing policies and proced ures for pr ogram or project implementation
58 and monitoring, which shall be rep orted to the committee;
59 (d) Ensuring graduates meet standards established by the committee;
60 (e) Maintaining accountability for failur e of graduates to meet standards
61 established by the committee; and
62 (f) Ensuring that each educational entity that pr ovides early childhood
63 education services demonstrates inclusion of the KPIs in curricula and graduation
64 r equir ements.
65 (4) (a) There is her eby established in the office of the secr etary of state the
66 "Quality Contr ol Committee for Oversight".
67 (b) The membership of the committee shall be composed of a senior employee or
68 member fr om each of the following:
69 a. The Missouri department of elementary and secondary education;
70 b. The Missouri department of higher education and workfor ce development;
71 c. The Missouri department of labor and industrial re lations;
72 d. The Missouri department of the National Guard;
73 e. The Missouri department of commer ce and insurance;
74 f. The Missouri department of social services;
75 g. The Missouri department of correct ions;
76 h. A state re prese ntative appointed by the speaker of the house of
7 7 r epresent atives; and
78 i. A state senator appointed by the presid ent pro tempor e of the senate.
79 (c) Each member of the committee shall serve a term of four years.
80 (d) The members of the committee shall select one of the committee members as
81 the chair of the committee. The chair shall be selected for a four -year term. The
82 position of chair of the committee shall be a full-time position. The member
83 r epr esenting the department, the state department of corr ections, or the state
84 department of social services shall not be eligible to be the chair . The members shall
85 r eceive no additional compensation for performing duties req uired of such member's
86 position on the committee but shall be rei mbursed for attending meetings with a per
87 diem amount as determined by the department and a travel fee not to exceed the
88 appr oved federal mileage rate.
89 (e) The committee shall hold meetings as determined by the committee.

90 (f) The committee may establish a working gro up or team to assist the committee
91 in carrying out the committee's duties. The members of such team may be full-time
92 employees of the committee.
93 (g) The committee shall have the following duties:
94 a. T o define:
95 (i) Outcome goals, objectives, and standards;
96 (ii) Means and methods for collecting outcome metrics; and
97 (iii) Reporting r equir ements and improvement r ecommendations;
98 b. T o maintain any adopted standards, means, methods, r eports, and
9 9 r ecommendations as public information;
100 c. T o establish quality contr ol test requi rem ents including, but not limited to:
101 (i) Determining the method by which success will be measur ed;
102 (ii) Establishing target standards or metrics to be used in determining the
103 success or failur e of department progr ams implemented by each educational entity; and
104 (iii) Establishing a post-graduation validation of the effectiveness of each
105 educational entity that is a high school, as determined by graduate participation in the
106 economy and community , which validation means, metrics, and methods shall include
107 any and all payr oll, state benefits, federal benefits, post-elementary and -secondary
108 education participation, and state department of corr ections data as deemed necessary
109 or sufficient by the committee;
110 d. T o implement an accessible system by which employers can rep ort employee
111 performance as it r elates to the KPIs and that state departments may use in determining
112 benefits eligibility; and
113 e. As each of the following applies to the department's mission and to the KPIs:
114 (i) T o dir ect department progr ams, project s, or activities res ponsible for quality
115 contr ol systems and methods;
116 (ii) T o establish policies and proc edures for examining each course offer ed by an
117 educational entity , for pr esenting to a school board a defense of such course in rel ation
118 to the course's objectives and the department's mission, and for appr oving such course
119 by the school board to which the course is defended;
120 (iii) T o adjudicate challenges to school board rulings on courses offer ed and
121 appr oved by the school board;
122 (iv) T o initiate challenges to courses offer ed or actions taken by educational
123 entities; and
124 (v) T o establish policies and pr ocedur es for assigning res ponsibility for a
125 student's postgraduate outcomes to educational entities that grant a diploma or a high
126 school equivalency (HSE) certificate, as determined by the committee.

127 (5) The secr etary of state shall:
128 (a) Hold the department accountable for graduates who fail to meet the KPIs
129 during high school and within five years after graduation;
130 (b) Hold the department and school districts or entities accountable for
131 individuals who fail to graduate on schedule or who fail to meet the KPIs; and
132 (c) Hold par ents accountable for students who are a r epeated disruption to the
133 learning envir onment.
134 (6) Subject to appr opriation, moneys allocated for diversity , equity , and
135 inclusion pr ograms or other similar pr ograms shall be available after the termination of
136 such progr ams only in such amounts necessary to cover the costs of implementing and
137 administering this subsection.
