AN ACT
T o amend chapter 302, RSMo, by adding thereto one new section relating to driver's
education requirements.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 302, RSMo, is amended by adding thereto one new section, to be
2 known as section 302.360, to read as follows:
302.360. 1. Beginning August 28, 2028, any driver's license applicant r equir ed
2 under this chapter to take a roa d skills test shall successfully complete an online ro ad
3 safety course prior to taking the r oad skills test. The online ro ad safety course shall
4 consist of at least five hours of instruction on the following:
5 (1) The hazards of distracted or impair ed driving;
6 (2) V ehicle-r elated crash and fatality awar eness and pr evention;
7 (3) Common safe driving habits; and
8 (4) Law enforcem ent pr ocedur es for traffic stops and appr opriate interactions,
9 including drivers' and passengers' rights.
10 2. Befor e January 1, 2028, the department of public safety shall develop and
11 accr edit, or contract with a third-party organization to develop and accr edit, an online
12 r oad safety course. The department of public safety shall consult and collaborate with
13 appr opriate traffic safety organizations regar ding the course curriculum.
14 3. The department of revenu e shall integrate the course onto its website for
15 accessibility to the public.
16 4. The Missouri state highway patrol shall ensure that only persons who have
17 successfully completed the online r oad safety course are permitted to take the ro ad skills

18 test. The department of rev enue shall maintain a secur e, electr onic database of all
19 persons who have completed the course, which shall be made accessible to the Missouri
20 state highway patrol for verification purposes.
21 5. The online r oad safety course shall be accessible to applicants without charge
22 prior to completion. Upon successful completion of the course, the department of
23 r evenue is authorized to collect a r easonable fee, not to exceed twenty dollars, fr om each
24 applicant. If the course is developed and administer ed by a third-party organization, all
25 fees collected shall be paid to that organization. If the course is administered by the
26 department of public safety , all fees collected shall be deposited into the driver safety
27 education fund established under subsection 6 of this section and used solely for the
28 administration, maintenance, and improv ement of the course.
29 6. (1) There is her eby cr eated in the state tr easury the "Driver Safety Education
30 Fund", which shall consist of moneys collected under subsection 5 of this section. The
31 state tr easur er shall be custodian of the fund. In accordance with sections 30.170 and
32 30.180, the state tr easur er may appr ove disbursements. The fund shall be a dedicated
33 fund and, upon appr opriation, moneys in this fund shall be used solely as pr ovided in
34 this section.
35 (2) Notwithstanding the pro visions of section 33.080 to the contrary , any moneys
36 r emaining in the fund at the end of the biennium shall not r evert to the credit of the
37 general reven ue fund.
38 (3) The state tre asurer shall invest moneys in the fund in the same manner as
39 other funds ar e invested. Any interes t and moneys earned on such investments shall be
40 cr edited to the fund.
41 7. The department of reven ue shall waive the online road safety course
42 r equir ement of this section if the applicant pr ovides proof that they successfully
43 completed a classr oom-based driver's education course in high school.
44 8. The pr ovisions of this section shall not apply to persons applying for a
45 commer cial driver's license.
46 9. The dir ector of the department of public safety may promulg ate all necessary
47 rules and reg ulations for the administration of this section. Any rule or portion of a
48 rule, as that term is defined in section 536.010, that is crea ted under the authority
49 delegated in this section shall become effective only if it complies with and is subject to
50 all of the pr ovisions of chapter 536 and, if applicable, section 536.028. This section and
51 chapter 536 are nonseverable and if any of the powers vested with the general assembly
52 pursuant to chapter 536 to revi ew , to delay the effective date, or to disappr ove and annul

53 a rule are subsequently held unconstitutional, then the grant of rulemaking authority
54 and any rule prop osed or adopted after August 28, 2026, shall be invalid and void.
