AN ACT
T o amend chapter 394, RSMo, by adding thereto one new section relating to optional service
by electrical cooperatives.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 394, RSMo, is amended by adding thereto one new section, to be
2 known as section 394.400, to read as follows:
394.400. 1. In any city with mor e than ten thousand but fewer than eleven
2 thousand inhabitants and that is the county seat of a county with mor e than thirty
3 thousand but fewer than thirty-five thousand inhabitants, any new structure, as such
4 term is defined in section 394.315, shall have the option to connect to any electrical
5 service available to such structur e, including any:
6 (1) Electrical corporation, as defined in section 386.020;
7 (2) Municipally owned or operated electric power system, as defined in section
8 91.025; or
9 (3) Rural electric cooperative organized and operating under the pr ovisions of
10 chapter 394.
11 2. Nothing in this section shall req uire any electric service pr ovider to enter into
12 a territorial agreement under section 394.312.
