AN ACT
T o amend chapter 210, RSMo, by adding thereto one new section relating to child care
facilities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 210, RSMo, is amended by adding thereto one new section, to be
2 known as section 210.224, to read as follows:
210.224. 1. This section shall be known and may be cited as "Conrad's Law".
2 2. As used in this section, the term "special needs" means special physical,
3 developmental, or behavioral needs.
4 3. The department of elementary and secondary education shall establish the
5 following for any licensed child care facility:
6 (1) T raining on and rules for nonr estrained safe sleep policies for childr en one
7 year of age or older and children with special needs. Such policies shall include safety
8 pr ocedur es for the use of a weighted blanket, except that no weighted blanket used in
9 the child car e facility shall:
10 (a) Exceed five pounds; or
11 (b) Be used on any child under one year of age;
12 (2) Safe res t options for any nonnapping child. Such options shall include an
13 exception for nonr estrained quiet-play activities or other activities so long as the
14 activities are supervised; and
15 (3) A car e plan for a child with special needs. Such car e plan shall be review ed,
16 agr eed upon, signed, and annually r eviewed by the child's par ents or legal guardians,
17 the child car e facility owner or dir ector , the child's primary care provi der , and any staff
18 member who is dir ectly r esponsible for the car e of the child.
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
19 4. All licensed and r egistered child care facilities shall complete at least one hour
20 of training r elated to special needs car e. If a child care facility is caring for a child with
21 special needs, all staff members who ar e directly res ponsible for the car e of such child
22 shall recei ve training specific to the needs of a child with that diagnosis. Such training
23 may count toward the requ ired annual training hours and shall be monitore d by the
24 office of childhood within the department of elementary and secondary education as
25 part of the licensed child car e pr ovider hours of training.
26 5. The prov isions of this section shall not apply to any child who is under one
27 year of age. Safe sleep policies for any child under one year of age shall be governed by
28 section 210.223.
