AN ACT
T o amend chapter 376, RSMo, by adding thereto one new section relating to health insurance
reimbursement of doula services.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 376, RSMo, is amended by adding thereto one new section, to be
2 known as section 376.1758, to read as follows:
376.1758. 1. For purposes of this section, the term "doula" means an individual
2 who has been trained to pr ovide physical, emotional, and educational support, but not
3 medical or midwifery care, to preg nant and birthing women and their families before,
4 during, and after childbirth.
5 2. The department of health and senior services shall r eview and appr ove doula
6 r egistration to allow for health insurance rei mbursement of doula services.
7 3. The department of health and senior services shall:
8 (1) Creat e the criteria for the doula r egistration application;
9 (2) Review applications for doulas to reg ister to re ceive health insurance
10 r eimbursement in this state;
11 (3) Appr ove or deny applications for doula registra tion based on the criteria
12 cr eated under subdivision (1) of this subsection;
13 (4) Notify applicants of appr oval or denial of doula regist ration. Any denial
14 notification shall include the specific reas on or r easons for the denial; and
15 (5) Maintain a statewide r egistry of doulas appr oved for health insurance
16 r eimbursement in this state.
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
17 4. In creat ing the criteria for the doula regist ration application to be used to
18 appr ove doula r egistration, the department of health and senior services shall consult
19 r elevant organizations including, but not limited to, the Missouri Community Doula
20 Council and other community doula organizations that support access to community-
21 based doula services in the state.
22 5. Nothing in this section pr ohibits any person fro m practicing as a doula in this
23 state regard less of whether the person is registe red in accordance with the pr ovisions of
24 this section.
25 6. The department of health and senior services shall pr omulgate all necessary
26 rules and reg ulations for the administration of this section. Any rule or portion of a
27 rule, as that term is defined in section 536.010, that is crea ted under the authority
28 delegated in this section shall become effective only if it complies with and is subject to
29 all of the pr ovisions of chapter 536 and, if applicable, section 536.028. This section and
30 chapter 536 are nonseverable and if any of the powers vested with the general assembly
31 pursuant to chapter 536 to revi ew , to delay the effective date, or to disappr ove and annul
32 a rule are subsequently held unconstitutional, then the grant of rulemaking authority
33 and any rule prop osed or adopted after August 28, 2026, shall be invalid and void.
