AN ACT
T o amend chapter 195, RSMo, by adding thereto one new section relating to marijuana
facilities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 195, RSMo, is amended by adding thereto one new section, to be
2 known as section 195.778, to read as follows:
195.778. 1. For purposes of this section, the following terms mean:
2 (1) "Applicant", an applicant for a license;
3 (2) "License", a compr ehensive marijuana cultivation facility license,
4 compr ehensive marijuana dispensary facility license, or compreh ensive marijuana-
5 infused pr oducts manufacturing facility license, as described in Article XIV , Section 2 of
6 the Constitution of Missouri;
7 (3) "Minimum standards", the minimum standards req uired to recei ve a license
8 that are consistent with the pr ovisions of Article XIV , Section 2 of the Constitution of
9 Missouri.
10 2. Due to the demand for marijuana in this state and consistent with its
11 obligation to lift or ease any limit on the number of licenses in order to meet such
12 demand as described in Article XIV , Section 2, Subsection 4, Subdivision (2) of the
13 Constitution of Missouri, the department of health and senior services shall issue a
14 license to any applicant who meets minimum standards for the license for which the
15 applicant applies.
16 3. Notwithstanding the pr ovisions of subsection 2 of this section to the contrary ,
17 the department of health and senior services may deny a license to an applicant who

18 meets minimum standards for the license for which the applicant applies in order to
19 comply with the ten percen t cap for ownership of licenses established in Article XIV ,
20 Section 2, Subsection 4, Subdivisions (9), (10), and (1 1) of the Constitution of Missouri.
21 4. The general assembly her eby abr ogates any limits on the number of licenses
22 established in reg ulations.
