AN ACT
T o repeal section 304.034, RSMo, and to enact in lieu thereof one new section relating to golf
cart operation.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 304.034, RSMo, is repealed and one new section enacted in lieu
2 thereof, to be known as section 304.034, to read as follows:
304.034. 1. Notwithstanding any other law to the contrary , the governing body of any
2 municipality may by resolution or ordinance allow persons to operate golf carts or motorized
3 wheelchairs upon any street or highway under the governing body's jurisdiction. Golf carts
4 and motorized wheelchairs shall be operated only on street s and highways that have a
5 posted speed limit of no mor e than twenty-five miles per hour , unless the res olution or
6 ordinance adopted by the municipality specifically authorizes the operation of golf carts
7 and motorized wheelchairs on street s and highways with a higher speed limit. A golf
8 cart or motorized wheelchair shall not be operated at any time on any state or federal
9 highway , but may be operated upon such highway in order to cross a portion of the state
10 highway system which intersects a municipal street. No golf cart or motorized wheelchair
11 shall cross any highway at an intersection where the highway being crossed has a posted
12 speed limit of more than forty-five miles per hour .
13 2. Golf carts operating on city street s under the pr ovisions of this section shall be
14 equipped with the following:
15 (1) At least two headlamps mounted at the same level with at least one on each
16 side of the front of the vehicle;
17 (2) At least two tail lamps;

18 (3) At least two rea r lamps that when lighted will exhibit a red light plainly
19 visible fro m a distance of fifty feet to the rear;
20 (4) At least electrical or mechanical turn signal devices;
21 (5) At least one r ed r eflector on each side of the vehicle as far to the r ear as
22 practicable;
23 (6) At least one red ref lector on the r ear of the vehicle;
24 (7) One exterior mirr or mounted on the driver's side of the vehicle;
25 (8) Either one exterior mirr or mounted on the passenger's side of the vehicle or
26 one interior mirr or;
27 (9) Operational brakes;
28 (10) A horn;
29 (1 1) A windshield;
30 (12) A manufactur er's identification number permanently affixed to the frame
31 of the vehicle;
32 (13) Safety belts on both fro nt and rear seats;
33 (14) Reliable steering apparatus; and
34 (15) Safe tir es.
35 3. In addition to safety equipment requ ired under subsection 2 of this section,
36 golf carts operated on city streets [ shall be equipped with adequate brakes and ] shall meet any
37 other safety requirements imposed by the governing body .
38 4. Golf carts are not subject to the registration provisions of chapter 301.
39 [ 3. ] 5. A person operating a golf cart under this section shall have a valid driver's
40 license issued under chapter 302.
41 6. Golf carts shall be subject to the insurance provi sions of chapter 303.
42 7. Unless authorized by the private owner of a sidewalk, golf carts shall not be
43 operated on sidewalks constructed for pedestrian use or on trails designated for
44 pedestrians and bicyclists.
45 8. Wher e a path for golf carts is designated and available for use that is adjacent
46 to a highway or street , a person operating a golf cart may , by local ordinance, be
47 r equir ed to use that designated path.
48 9. A person operating a golf cart shall drive the vehicle as near to the right side
49 of the roa dway as practicable.
50 10. A person operating or riding in a golf cart shall not be re quir ed to wear
51 pr otective headgear .

52 1 1. As used in this section, a "golf cart" means a motor vehicle that is designed and
53 manufactured for operation on a golf course for sporting or recreational purposes and that is
54 not capable of exceeding speeds of [ twenty ] twenty-five miles per hour .
