AN ACT
T o amend chapter 536, RSMo, by adding thereto one new section relating to administrative
rules.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 536, RSMo, is amended by adding thereto one new section, to be
2 known as section 536.180, to read as follows:
536.180. 1. No rule or portion of a rule promulg ated under this chapter shall
2 become effective until it has been appr oved by the general assembly as pr ovided in this
3 section. The delegation of legislative authority to enact laws by the adoption of such
4 rules is dependent upon the power of the joint committee on administrative rules to
5 r eview and suspend rules pending ratification by the senate and the house of
6 r epresent atives as pr ovided in this section.
7 2. Upon filing any pr oposed rule with the secr etary of state, the filing agency
8 shall concurr ently submit such prop osed rule to the joint committee on administrative
9 rules, which may hold hearings on any pro posed rule or portion ther eof at any time. A
10 final order of rulemaking shall not be filed with the secr etary of state until thirty days
11 after such final order of rulemaking has been received by the committee, except as
12 pr ovided in this subsection.
13 3. If a fiscal note re quir ed under this chapter for a pr oposed rule estimates costs
14 in excess of two hundred fifty thousand dollars, the committee shall suspend the order of
15 rulemaking or portion ther eof by action taken prior to the filing of the final order of
16 rulemaking. If the general assembly does not appr ove of a pr oposed rule, the filing

17 agency shall not file such pro posed rule with the secr etary of state and the secr etary of
18 state shall not publish the final order of rulemaking in the Missouri reg ister .
19 4. The general assembly may adopt a concurr ent res olution in accordance with
20 the pr ovisions of Article IV , Section 8 of the Constitution of Missouri to appr ove a
21 pr oposed rule.
22 5. Upon adoption of such concurr ent r esolution as prov ided in subsection 4 of
23 this section, the secr etary of state shall not publish the order of rulemaking until the
24 expiration of time necessary for such r esolution to be signed by the governor or vetoed
25 and subsequently acted upon by the general assembly as pr ovided in Article III, Section
26 32 of the Constitution of Missouri. If such concurr ent res olution is adopted and signed
27 by the governor or otherwise r econsider ed under Article III, Section 32 of the
28 Constitution of Missouri, the secr etary of state shall publish in the Missouri regi ster , as
29 soon as practicable, the order of rulemaking along with notice of the pr oposed rules or
30 portions ther eof that wer e appr oved by the general assembly .
31 6. Except as pr ovided in section 536.025, any rule, or amendment or res cission
32 ther eof, shall be null, void, and unenfor ceable unless made in accordance with the
33 pr ovisions of this section.
