AN ACT
T o repeal sections 168.201 and 168.205, RSMo, and to enact in lieu thereof two new sections
relating to school administrators.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 168.201 and 168.205, RSMo, are repealed and two new sections
2 enacted in lieu thereof, to be known as sections 168.201 and 168.205, to read as follows:
168.201. 1. Except as otherwise pr ovided in section 168.205, the board of
2 education in all districts except metropolitan districts may employ and contract with a
3 superintendent for a term not to exceed three years from the time of making the contract, and
4 may employ such other servants and agents as it deems necessary , and prescribe their powers,
5 duties, compensation and term of of fice or employment which shall not exceed three years.
6 [ It ] 2. The board shall provide and keep a corporate seal.
168.205. 1. Notwithstanding any provision of law to the contrary , two or more school
2 districts may share a superintendent who possesses a valid Missouri superintendent's license.
3 If any school districts choose to share a superintendent, they shall not be required to receive
4 approval from the department of elementary and secondary education but may notify the
5 department.
6 2. (1) Beginning July 1, 2023, subject to appropriation, a school district that enters
7 into an agreement with another school district to share a superintendent shall receive
8 additional state aid under this subsection.
9 (2) The department of elementary and secondary education shall annually distribute
10 thirty thousand dollars to any school district that shares a superintendent under this

11 subsection. Any such amount distributed to a school district shall be in addition to and shall
12 not be included in any calculation of state aid under chapter 163.
13 (3) T o receive the additional thirty thousand dollars under this subsection, the school
14 district shall provide proof to the department of elementary and secondary education that the
15 school district will use all of the additional thirty thousand dollars received under this
16 subsection and at least half of the amount saved as a result of participating in sharing a
17 superintendent under this subsection to compensate teachers or to provide counseling
18 services.
19 (4) No school district that receives additional funding under this subsection shall
20 receive such funding for more than five years.
21 3. (1) As used in this subsection, "school administrator" means a
2 2 superintendent, assistant superintendent, or a director .
23 (2) The state board of education shall evaluate the administration of each school
24 district with a majority of its boundaries located within a county with mor e than one
25 million inhabitants. After such evaluation, the state board shall:
26 (a) Consolidate the school administrators for school districts that have fewer
27 than ten thousand students so that one superintendent, one assistant superintendent,
28 and one director serves no fewer than ten thousand students;
29 (b) Determine the appr opriate number of additional administrative staff needed
30 for each school district that is administer ed by consolidated school administrators under
31 this subsection. Such staff positions include, but ar e not limited to, the dir ectors of
32 curriculum, communications, transportation, public safety , food services, and human
33 r esources ; and
34 (c) Determine how standards relat ing to administrative staff in the Missouri
35 school improvemen t plan or any subsequently adopted accr editation method are met or
36 waived.
37 (3) A consolidation of school administrators under this subsection shall be
38 subject to the following:
39 (a) The salary of a consolidated school administrator shall be shar ed
40 pr oportionally among the school districts with a consolidated school administrator;
41 (b) A school district with mor e than ten thousand enr olled students may
42 consolidate school administrators; and
43 (c) School districts that consolidate school administrators shall share a physical
44 border .
45 (4) Subsection 1 of this section shall not apply to a school district that
46 consolidates school administrators under this subsection.

47 (5) This subsection shall not apply to a school district that receiv es less than
48 twenty percen t of its funding fr om the state.
49 (6) This subsection shall apply beginning in the 2027-28 school year and in all
50 subsequent school years.
