AN ACT
T o amend chapter 31 1, RSMo, by adding thereto one new section relating to the establishment
of certain entertainment districts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 31 1, RSMo, is amended by adding thereto one new section, to be
2 known as section 31 1.083, to read as follows:
31 1.083. 1. As used in this section, the following terms mean:
2 (1) "Common area ", any public area within an entertainment district and any
3 ar ea of a public right-of-way that is within the entertainment district. "Common area"
4 shall not include ar eas open to the public that are located within an establishment
5 licensed under this chapter;
6 (2) "Entertainment district", any ar ea in any county that:
7 (a) a. Borders on or that contains part of a lake with no less than one thousand
8 miles of shor eline and that is located in any city with mor e than four thousand four
9 hundr ed but fewer than four thousand nine hundred inhabitants and partially located
10 in a county with mor e than forty thousand but fewer than fifty thousand inhabitants; or
11 b. Borders the Missouri river , and that is located in any city with mor e than
12 forty-six thousand but fewer than fifty-one thousand inhabitants;
13 (b) Contains a combination of entertainment venues, bars, nightclubs,
1 4 r estaurants, and other licensed establishments and common areas; and
15 (c) Is designated as such by an ordinance of the governing body of the city;
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
16 (3) "Portable bar", any bar , table, kiosk, cart, or stand that is not a permanent
17 fixtur e and can be moved fro m place to place.
18 2. Notwithstanding any other provi sions of this chapter to the contrary , any
19 person who possesses the qualifications r equir ed under this chapter , and who meets the
20 r equir ements of and complies with the pr ovisions of this chapter , may apply for , and the
21 supervisor of alcohol and tobacco control may issue, an entertainment district special
22 license to sell intoxicating liquor by the drink for reta il for consumption dispensed fr om
23 one or mor e licensed establishments including, but not limited to, portable bars within
24 the entertainment district, until 1:30 a.m. on Mondays thr ough Saturdays and fr om 6:00
25 a.m. on Sundays and until 1:30 a.m. on Mondays.
26 3. An applicant granted an entertainment district special license under this
27 section shall pay a license fee of thr ee hundr ed dollars per year .
28 4. Notwithstanding any other pr ovision of this chapter to the contrary , on such
29 days and at such times during the hours a licensee is allowed under this chapter to sell
30 alcoholic beverages, licensed establishments holding an entertainment district special
31 license under this section, may allow persons to leave the licensed pr emises located in
32 portions of the entertainment district with an alcoholic beverage and enter upon and
33 consume the alcoholic beverage within other licensed establishments and common areas
34 located in portions of the entertainment district. No person shall take any alcoholic
35 beverage or alcoholic beverages outside the boundaries of the entertainment district.
36 5. Every licensee within the entertainment district shall serve alcoholic
37 beverages in containers that display and contain the licensee's trade name or logo or
38 some other mark that is unique to that license and licensee.
39 6. The holder of an entertainment district special license is solely r esponsible for
40 alcohol violations occurring on its premis es, including any portable bar , and in any
41 common area .
42 7. The governing body of the city in which the entertainment district is located
43 shall be authorized to adopt by ordinance pr ocedur es for appr oval or rej ection of such
44 entertainment districts as well as rules and r egulations for conduct and enforcem ent
45 ther eof consistent with this section.
