AN ACT
T o amend chapter 161, RSMo, by adding thereto one new section relating to virtual schools.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 161, RSMo, is amended by adding thereto one new section, to be
2 known as section 161.672, to read as follows:
161.672. 1. As used in this section, the following terms mean:
2 (1) "Adult student", an individual who:
3 (a) Resides in this state;
4 (b) Does not have a high school diploma or a high school equivalency certificate
5 issued by any state;
6 (c) Is twenty-one years of age or older; and
7 (d) Has fewer than twelve credi ts r emaining or a total of two academic years
8 r emaining to achieve a high school diploma in the state of Missouri. For purposes of this
9 paragraph, the term "cr edits rem aining" shall not be construed to include cred its
10 earned toward career and technical education courses or attainment of an industry-
11 r ecognized creden tial, technical skills assessment, or stackable cr edential;
12 (2) "Adult virtual pr ogram", a state-approved virtual course or full-time virtual
13 pr ogram offered by a school district or a public institution of higher education.
14 2. An adult student may enr oll in an adult virtual pr ogram and shall be eligible
15 to enrol l in the Missouri course access and virtual school pr ogram established in section
16 161.670.
17 3. (1) An adult virtual pr ogram under this subsection shall not be entitled to any
18 moneys paid to the school district as ordinary school reven ue including, but not limited

19 to, local effort calculated under chapter 163. Such pr ogram pr ovider shall be entitled to
20 r eceive a monthly state allocation fr om the department of elementary and secondary
21 education, derived solely fr om the state moneys the department collects and distributes
22 based on the state adequacy target as defined in section 163.01 1, in excess of any
23 minimum fr ee public school funding and separate fr om any payment fr om the public
24 school fund as r equir ed by Article IX of the Constitution of Missouri. Subject only to
25 such re strictions, each successfully passed and completed course shall result in payment
26 to the pro gram equal to fourteen per cent of the state adequacy target.
27 (2) The total amount pr ovided for an adult student enr olled in an adult virtual
28 pr ogram shall not exceed the state adequacy target.
29 4. No school district with an adult student enr olled in an adult virtual pr ogram
30 shall be req uired to repo rt such adult student's information for purposes of a repor t
31 submitted under section 160.522 or 161.670.
