AN ACT
T o amend chapter 29, RSMo, by adding thereto one new section relating to audits of state
entities.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 29, RSMo, is amended by adding thereto one new section, to be
2 known as section 29.233, to read as follows:
29.233. 1. The state auditor shall conduct performance audits for economy and
2 efficiency at least once every four years on each of the state departments, the general
3 assembly , the judiciary , and departments and offices under the executive branch
4 including, but not limited to, the office of administration, the governor , the lieutenant
5 governor , the attorney general, the secr etary of state, the state auditor , and the state
6 tr easur er .
7 2. Within thirty days of receivi ng the res ults of the audit, the entity shall post the
8 r esults on its website.
9 3. The state auditor shall submit the res ults of each audit to the general
10 assembly .
11 4. Any entity that fails to participate in the audits req uired under subsection 1 of
12 this section shall be subject to suit for declaratory judgment and injunctive relief,
13 br ought by the attorney general in the cir cuit court of Cole County . The entity shall not
14 have use of the attorney general's legal services for such suit and shall be requ ired to
15 r etain its own counsel.
