AN ACT
T o amend chapter 379, RSMo, by adding thereto one new section relating to insurance
coverage for damage to siding on real property .
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 379, RSMo, is amended by adding thereto one new section, to be
2 known as section 379.970, to read as follows:
379.970. 1. As used in this section, the following terms mean:
2 (1) "Dwelling-owners' insurance", the same meaning given to the term in section
3 374.400;
4 (2) "Homeowners' insurance", the same meaning given to the term in section
5 374.400;
6 (3) "Insurer ", any insurance company , including any recip rocal or inter -
7 insurance exchange, licensed and authorized by the dire ctor to write homeowners'
8 insurance or dwelling-owners' insurance upon prop erty located within this state.
9 2. Each insurer that offers or issues policies of dwelling-owners' insurance or
10 homeowners' insurance that ar e deliver ed, issued for delivery , continued, or ren ewed in
11 this state on or after January 1, 2027, and that pr ovide coverage for damage to siding on
12 r eal prop erty shall prov ide coverage as re quir ed under this section.
13 3. If the damage to the siding to be cover ed by the insur er affected only part of
14 the siding on the structur e and r eplacement siding that matches the adjacent siding in
15 quality , color , and size is not reas onably available, the insur er shall:
16 (1) For damage cover ed under a homeowners' insurance policy , rep lace all
17 siding on the structure so as to conform to a reas onably uniform appearance; and
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 (2) For damage cover ed under a dwelling-owners' insurance policy , pay an
19 amount equal to the amount the insurer would have paid if the cover ed damage had
20 occurr ed on all siding on the structur e.
