AN ACT
T o repeal section 170.057, RSMo, and to enact in lieu thereof one new section relating to
school supplies.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 170.057, RSMo, is repealed and one new section enacted in lieu
2 thereof, to be known as section 170.057, to read as follows:
170.057. 1. The school board of any school district may expend either textbook fund
2 moneys or incidental fund moneys to provide supplementary texts, library reference books,
3 instructional supplies , and contractual educational television services for the pupils of the
4 district's elementary and secondary schools.
5 2. (1) This subsection shall be known and may be cited as the "Missouri
6 T eachers Classr oom Supply Assistance Pr ogram".
7 (2) As used in this subsection, "school supplies" has the same definition as in
8 section 144.049.
9 (3) For the 2027-28 school year and all subsequent school years, the department
10 of elementary and secondary education shall pr ovide moneys to each school district and
11 charter school for each of the school district's and charter school's teachers to pur chase
12 classr oom materials and school supplies for the students in the teachers' classr ooms. No
13 such moneys shall be used to pur chase equipment.
14 (4) The department shall calculate an amount of such moneys for each school
15 district and charter school based on the average daily attendance of re sident pupils
16 enr olled in the school district or charter school in the previ ous year and distribute such
17 amount to each school district and charter school before August first of each year .

18 (5) Upon recei pt of the moneys calculated under subdivision (4) of this
19 subsection, each school district and charter school shall calculate an identical amount of
20 such moneys for each teacher estimated to be employed on September first of the school
21 year and make available such amount to each teacher before August fifteenth of each
22 year .
23 (6) The department shall establish a method for each school district and charter
24 school to pr ovide each teacher with a debit card to use for pur chasing classr oom
25 materials and supplies with the amount calculated in subdivision (5) of this subsection.
26 Any debit card issued under this section shall clearly indicate on the fr ont that the card
27 has been issued for the Missouri teachers classr oom supply assistance prog ram, shall
28 display the expiration date on the back of the card, and shall display the school district's
29 or charter school's tax exempt number on the fr ont or the back of the card. The
30 department shall determine any necessary pr ocedur es and r equir ements for use of the
31 debit cards.
32 (7) Each teacher who accepts a debit card under this section shall sign a
33 statement developed by the department that acknowledges recei pt and the terms of
34 pr oper use of the debit card.
35 (8) Each teacher who uses a debit card pro vided under this section shall submit
36 all receipts for all pur chases made with such card to the school district or charter school.
37 The school district or charter school shall keep all such recei pts for at least five years to
38 show that moneys expended meet the r equir ements of this section.
39 (9) Any unexpended amount available for teachers under this subsection shall
40 r emain in the account established for the deposit of moneys under this section and shall
41 be available for distribution to teachers in subsequent years.
42 (10) The department may promul gate all necessary rules for the administration
43 of this section. Any rule or portion of a rule, as that term is defined in section 536.010,
44 that is cre ated under the authority delegated in this section shall become effective only if
45 it complies with and is subject to all of the pro visions of chapter 536 and, if applicable,
46 section 536.028. This section and chapter 536 are nonseverable and if any of the powers
47 vested with the general assembly pursuant to chapter 536 to revi ew , to delay the
48 effective date, or to disappr ove and annul a rule are subsequently held unconstitutional,
49 then the grant of rulemaking authority and any rule pr oposed or adopted after the
50 effective date of this section shall be invalid and void.
