AN ACT
T o amend chapter 197, RSMo, by adding thereto one new section relating to multidose
medications given to patients at dischar ge.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 197, RSMo, is amended by adding thereto one new section, to be
2 known as section 197.180, to read as follows:
197.180. 1. Medications in multidose containers that are administered to or used
2 for a patient during the patient's hospital stay may , if so order ed by an authorized
3 health car e pro vider , be sent with the patient at discharge to the patient's home or to
4 another health car e facility .
5 2. Multidose medications shall include, but ar e not limited to, inhalers,
6 ointments, creams , medications requ iring the original container for dispensing, insulin
7 pens and vials, eye dr ops, ear dr ops, wearable or on-body medication delivery systems,
8 and infusions that ar e curr ently connected to the patient's infusion device.
9 3. Multidose medications shall be labeled with the date, patient's name,
10 pr escriber's name, name and addr ess of the hospital, medication name and str ength,
11 instructions for use, and other pertinent information. Labeling shall be performed by a
12 pharmacist, pr escriber , or reg istered nurse. Labeled instructions for use may ref er to
13 specific written instructions pro vided by a pharmacist, pr escriber , or regi stered nurse at
14 the time of discharge.
15 4. Control led substances shall not be sent with the patient, except that wearable
16 or on-body medication delivery systems of contr olled substances or controlled substance
17 infusions curr ently connected to the patient's infusion device may be sent if:

18 (1) The medication is necessary for administration during transport of the
19 patient;
20 (2) The quantity of the contr olled substance sent is documented in the patient's
21 medical record by the person sending the medication; and
22 (3) The pharmacy is notified that the medication is being sent with the patient.
23 5. This section shall not requi re a class B hospital pharmacy to obtain or comply
24 with additional licensur e or reg ulatory requi rem ents.
