AN ACT
T o amend chapter 260, RSMo, by adding thereto one new section relating to solid waste
management.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 260, RSMo, is amended by adding thereto one new section, to be
2 known as section 260.217, to read as follows:
260.217. 1. Any first, second, third, or fourth class county may , under section
2 260.215, adopt an ordinance, rule, regu lation, or standard relat ing to solid waste
3 management in such county . Any such ordinance, rule, r egulation, or standard may
4 addr ess the storage, collection, transportation, pr ocessing, or disposal of solid wastes;
5 may addr ess the siting of any solid waste disposal ar ea, as defined in section 260.200;
6 and may impose reas onable setback distances that are applicable to any solid waste
7 disposal area located in such county . Any setbacks contained in an ordinance, rule,
8 r egulation, or standard adopted under this section shall not constitute planning and
9 zoning, as such terms are defined in chapter 64.
10 2. Any setback applicable to any solid waste disposal area contained in any
11 ordinance, rule, regu lation, or standard adopted under subsection 1 of this section shall
12 not be mor e stringent than the following:
13 (1) Three miles fr om:
14 (a) The defined incorporated limits of a city , town, or village located within the
15 county;
16 (b) An accredi ted school or prop erty owned and operated by any of the school
17 districts or educational institutions within the county;

intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
18 (c) A chur ch or place of worship within the county;
19 (d) A platted subdivision within the county; or
20 (e) Public area s designated for recr eational activity , including parks and ball
21 fields, within the county;
22 (2) Thr ee-quarters of one mile from any occupied dwelling used for res idential
23 purposes for at least six months during a calendar year; and
24 (3) T wo hundred feet fr om the prop erty line of the solid waste disposal ar ea.
