AN ACT
T o amend chapter 407, RSMo, by adding thereto one new section relating to purchasing of
prepaid mobile devices, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be
2 known as section 407.3450, to read as follows:
407.3450. 1. As used in this section, the following terms mean:
2 (1) "Minor", an individual under eighteen years of age;
3 (2) "Person", an individual who is not the par ent or legal guardian of a minor;
4 (3) "Prepai d mobile device", a cellular telephone or other communication device
5 for which the mobile device user purch ases a set allotment of wir eless communication
6 services;
7 (4) "W ireless communication services", any mobile service that is pr ovided for
8 pr ofit and makes inter connected service available to the public.
9 2. (1) No minor shall pur chase a prepa id mobile device or ref ill a pr epaid mobile
10 device with wir eless communication services on a pr eviously pur chased pr epaid mobile
11 device.
12 (2) No person shall pur chase a prep aid mobile device or ref ill a pr epaid mobile
13 device with wir eless communication services on a pr eviously pur chased pr epaid mobile
14 device for a minor .
15 3. (1) A violation under subdivision (1) of subsection 2 of this section shall be an
16 infraction.
EXPLANA TION — Matter enclosed in bold-faced brackets [thus] in the above bill is not enacted and is
intended to be omitted from the law . Matter in bold-face type in the above bill is proposed language.
17 (2) For the first violation under subdivision (2) of subsection 2 of this section, the
18 person shall be guilty of a class D misdemeanor . For a second and any subsequent
19 violation of subdivision (2) of subsection 2 of this section, or if the person has a history of
20 crimes against childre n, the person shall be guilty of a class A misdemeanor .
