AN ACT
T o repeal sections 31 1.630 and 320.230, RSMo, and to enact in lieu thereof two new sections
relating to peace of ficer duties.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 31 1.630 and 320.230, RSMo, are repealed and two new sections
2 enacted in lieu thereof, to be known as sections 31 1.630 and 320.230, to read as follows:
31 1.630. 1. The supervisor of alcohol and tobacco control and employees to be
2 selected and designated as peace of ficers by the supervisor of alcohol and tobacco control are
3 hereby declared to be peace of ficers of the state of Missouri, with full power and authority to
4 make arrests and searches and seizures only for violations of the provisions of this chapter
5 relating to intoxicating liquors, [ and ] sections 407.924 to 407.934 relating to tobacco
6 products, or when exigent circu mstances that pr esent an immediate thr eat of bodily
7 harm to any person exist, and to serve any process connected with the enforcement of such
8 laws. The peace officers so designated shall have been previously appointed and qualified
9 under the provisions of section 31 1.620 and shall be required to hold a valid peace of ficer
10 license pursuant to chapter 590.
11 2. The supervisor of alcohol and tobacco control shall furnish such peace of ficers
12 with credentials showing their authority and a special badge, which they shall carry on their
13 person at all times while on duty . The names of the peace of ficers so designated shall be
14 made a matter of public record in the of fice of the supervisor of alcohol and tobacco control.
15 3. All fees for the arrest and transportation of persons arrested and for the service of
16 writs and process shall be the same as provided by law in criminal proceedings and shall be
17 taxed as costs.

320.230. 1. The state fire marshal shall conduct investigations and may conduct
2 hearings into the cause, origin, or circumstances of fire losses and shall cooperate with the
3 appropriate fire or police of ficials of this state or its political subdivisions in investigations of
4 the cause, origin or circumstances of fires, explosions or related occurrences involving the
5 possibility of arson or related of fenses.
6 2. The state fire marshal and the marshal's paid investigators who have attained
7 proper certification as peace of ficers pursuant to chapter 590 as approved by the director of
8 the department of public safety shall be deemed to be peace of ficers and shall notify the local
9 law enforcement agency of the existence of the investigators and shall have the power of
10 arrest for all of fenses incident to the investigation of the cause, origin or circumstances of
11 fires, fir eworks, explosions or like occurrences involving the possibility of arson, or related
12 of fenses, and in connection with any of fenses when aiding and assisting the sheriff of any
13 county or the chief of police of any municipality , or their designated representatives, at their
14 request , or when exigent circums tances that present an immediate thr eat of bodily harm
15 to any person exist .
