AN ACT
T o amend chapter 640, RSMo, by adding thereto one new section relating to weather
modification.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 640, RSMo, is amended by adding thereto one new section, to be
2 known as section 640.870, to read as follows:
640.870. 1. As used in this section, the following terms mean:
2 (1) "Department", the Missouri department of natural res ources;
3 (2) "W eather modification", any activity performed with the intention of
4 pr oducing artificial changes to the composition, behavior , or dynamics of the
5 atmospher e including, but not limited to:
6 (a) Dispersing substances into the air that serve as cloud condensation or ice
7 nuclei, which alter the micr ophysical pr ocess within the cloud;
8 (b) Dr opping pollution or biological agents fr om any form of airc raft designed to
9 alter the earth's atmospher e, manipulate the envir onment, or cause harm to the food
10 supply; or
11 (c) The use of cloud seeding, meaning dire cting rainfall to a specific location by a
12 pr ocess of injecting, rele asing, or dispersing chemicals into the atmospher e.
13 2. It shall be unlawful to use any form of weather modification in the state.
14 3. Any individual may r eport violations of this section to the department. The
15 department shall cr eate an online publicly accessible form for r eporting weather
16 modification under this section. The department shall crea te proc edures to investigate
17 every such rep ort to determine whether weather modification occurr ed.

18 4. If the department finds that weather modification occurred , the department
19 shall commence a civil action in the court of competent jurisdiction. If the court finds
20 that a violation occurr ed, the court may grant damages, injunctive r elief, attorney's fees,
21 and any such other reli ef the court finds appr opriate.
22 5. The department shall repo rt any known instance of weather modification to
23 the administrator of the national oceanic and atmospheric administration pursuant to
24 15 CFR Section 908.
25 6. Nothing in this section shall be construed to pr event the use of pesticides on
26 any farming or ranching operation in the state.
27 7. The department may pr omulgate all necessary rules and r egulations for the
28 administration of the prov isions of this section. Any rule or portion of a rule, as that
29 term is defined in section 536.010, that is creat ed under the authority delegated in this
30 section shall become effective only if it complies with and is subject to all of the
31 pr ovisions of chapter 536 and, if applicable, section 536.028. This section and chapter
32 536 are nonseverable and if any of the powers vested with the general assembly
33 pursuant to chapter 536 to revi ew , to delay the effective date, or to disappr ove and annul
34 a rule are subsequently held unconstitutional, then the grant of rulemaking authority
35 and any rule prop osed or adopted after August 28, 2026, shall be invalid and void.
