AN ACT
T o amend chapter 644, RSMo, by adding thereto one new section relating to water storage in
a reservoir owned by the U.S. Army Corps of Engineers.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 644, RSMo, is amended by adding thereto one new section, to be
2 known as section 644.083, to read as follows:
644.083. 1. Notwithstanding any other pro vision of law , a person who has
2 contracted for the right to stor e water in a r eservoir owned by the U.S. Army Corps of
3 Engineers shall have exclusive rights to any ret urn flows generated dir ectly or indirect ly
4 to that r eservoir by the person. The rights conferred by this section shall be subject to
5 any r egulatory requ irem ents imposed by this state and to the availability to the person
6 of unused storage capacity within the rese rvoir to store such retu rn flows.
7 2. As used in this section, "re turn flow" means water that is discharged dir ectly
8 or indirect ly to a res ervoir fro m a water reclamat ion facility .
