AN ACT
T o amend chapter 488, RSMo, by adding thereto one new section relating to a special
surchar ge in certain cases for the construction of a new courthouse.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 488, RSMo, is amended by adding thereto one new section, to be
2 known as section 488.449, to read as follows:
488.449. 1. The cir cuit and associate cir cuit judges of the cir cuit court in Scott
2 County shall req uire any party filing a civil case in such court, at the time of filing suit,
3 to deposit with the cir cuit clerk a sur charge in the amount of forty-five dollars, in
4 addition to all other court costs now or her eafter requ ired by law or court rule, and no
5 summons shall be issued until such sur charge has been paid. This section shall not
6 apply to pr oceedings when costs ar e waived or paid by the state, county , or municipality .
7 2. Such funds shall be payable to the cir cuit clerk of Scott County to be cr edited
8 to a courthouse construction fund, which shall bear interes t, to be used only for the
9 planning and construction of a new courthouse in Scott County , pr ovided that the
10 courthouse construction fund may be pledged to dir ectly or indirectl y secure bonds to
11 fund such costs.
12 3. This section shall expir e on August 28, 2046.
