AN ACT
T o amend chapter 442, RSMo, by adding thereto one new section relating to sales price
disclosure in real estate sales, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 442, RSMo, is amended by adding thereto one new section, to be
2 known as section 442.383, to read as follows:
442.383. 1. A person shall not file for record or have r ecorded in the office of the
2 county r ecorder of deeds an instrument conveying any real estate under a contract for
3 sale unless the instrument discloses the sales price of the rea l estate.
4 2. The pur chaser of any r eal estate for which an instrument is r ecorded in
5 violation of subsection 1 of this section is liable to the state for a civil penalty for each
6 violation in an amount equal to five per cent of the sales price of the r eal estate.
7 3. The attorney general or the pr osecuting attorney of the county in which the
8 r eal estate is located may bring suit to r ecover a penalty under this section.
9 4. The pr ovisions of this section shall not apply to an instrument conveying only
10 a mineral inter est in rea l estate.
