AN ACT
T o amend chapter 324, RSMo, by adding thereto one new section relating to a prohibition on
licensing requirements for certain industrial mechanical maintenance work.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 324, RSMo, is amended by adding thereto one new section, to be
2 known as section 324.890, to read as follows:
324.890. 1. As used in this section, the following terms mean:
2 (1) "Contractor", a person who is employed by a corporation, firm, institution,
3 organization, or company to perform mechanical work or industrial mechanical
4 maintenance work;
5 (2) "Establishment", any legally r ecognized business entity engaged in
6 manufacturing;
7 (3) "Industrial facility", any real prop erty or personal pr operty or fixtur es
8 attached to real pro perty at which an establishment engages in a manufacturing activity
9 within an area that, if subject to a zoning ordinance or r egulation, is zoned for industrial
10 or similar uses;
11 (4) "Industrial mechanical maintenance work", maintenance of mechanical
12 systems or equipment within an industrial facility;
13 (5) "Local license", a license issued by a political subdivision and valid only in
14 that political subdivision that is r equir ed to bid, accept, or perform mechanical work in
15 a political subdivision of this state;
16 (6) "Manufacturing", any activity described in division D of the most recen t
17 version of the Standard Industrial Classification Manual;

18 (7) "State license", a license issued by the state of Missouri that is requ ired to
19 bid, accept, or perform mechanical work in this state.
20 2. Any contractor performing industrial mechanical maintenance work
21 employed at an industrial facility shall not be req uired to obtain a local license or
22 state license to perform industrial mechanical maintenance work for the industrial
23 facility .
