AN ACT
T o amend chapter 208, RSMo, by adding thereto one new section relating to MO HealthNet
eligibility .
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 208, RSMo, is amended by adding thereto one new section, to be
2 known as section 208.203, to read as follows:
208.203. 1. The MO HealthNet division shall expedite a verification for each
2 MO HealthNet benefits application that the applicant is not curr ently enr olled in any
3 other state's Medicaid pro gram or in any qualified health plan offer ed thr ough a health
4 benefit exchange established under the Patient Pr otection and Affordable Care Act, 42
5 U.S.C. Section 18001 et seq. An applicant re locating fr om an uncooperative state may
6 be asked to pr ovide a certificate of nonenroll ment fro m that state.
7 2. Any applicant for MO HealthNet benefits curren tly enro lled in a prog ram or
8 plan described in subsection 1 of this section may terminate his or her enro llment to
9 become eligible for MO HealthNet benefits. The division shall not appr ove the
10 application for MO HealthNet benefits until the termination of enro llment in the other
11 pr ogram or plan is effective.
